In the extraordinary conference from the blue headquarters, Sali Berisha objected to the security measure imposed on him by forcing him to present and blocking his passport, as he said that SPAK has violated the Constitution with this decision against him.
Berisha said that the Assembly should be called first to give permission for the execution of such a security measure, but the law says otherwise.
According to the law, the authorization of the parliamentary commission that Berisha claimed, on the part of SPAK, the authorization is required for a deputy in cases where arrest in prison, house arrest and control of the apartment is required.
While for the easier measures such as "obligation to appear" and "blocking the exit from the country" there is no legal restriction and there is no need for authorization from the commission of mandates.
Berisha escaped the security measure for all three charges because of his 79 years of age.
As the law stipulates that a severe restraining order cannot be imposed on persons over 72 years of age who are accused of non-serious criminal offences.
