The Ministry of Foreign Affairs of Albania reacted regarding the verbal note of the Russian embassy for those arrested as suspected of espionage.
The Ministry clarifies, among other things, that the Albanian authorities were unable to notify the Russian embassy of the detention of these two citizens, as it contradicts the Vienna Convention.
According to article 36, point 1.b, of this convention, the MEPJ explains, "the receiving state, in this case Albania, must notify the diplomatic mission of the sending state, in this case Russia, of their detention, only if the detainees themselves request to contact their embassy".
The reaction comes after the claims of the Russian embassy in Tirana that the Ministry for Europe and Foreign Affairs has not responded to this embassy's note for days, for information on the detention of Russian citizens due to attempts to forcibly enter the military zone.
Full statement:
Regarding the claims of the Russian embassy in Tirana that the Ministry for Europe and Foreign Affairs has not responded to this embassy's note for days, for information on the detention of Russian citizens due to attempts to forcibly enter the military zone, the General Secretary of MEPJ, Mr. Gazmend Turdiu declares with responsibility that all the actions of MEPJ regarding this matter are in full compliance with the Vienna Convention on Consular Relations of 1963, as well as with the conventions for the protection of personal data, to which Albania is a party.
MEPJ has received a verbal note from the Russian embassy, in an attempt to obtain information on two Russian citizens detained at the entrance of a military facility. But it is absolutely untrue that this note has been sent for four days. The grade was drafted on August 22 and entered the MEPJ on August 23 in the afternoon. The Ministry of Internal Affairs immediately addressed a request for information to the competent authorities. We emphasize that at this point MEPJ is the liaison point between the applicant and other structures and has no other competence for the matter in question.
In the context of transparency and the rejection of disinformation, the MEPJ is ready to make available to the media and public opinion a copy of the note, where the number and date of sending, August 22, 2022, are clearly visible.
The Albanian authorities found it impossible to notify the Russian embassy of the detention of these two citizens, because the Vienna Convention referred to above, Article 36, point 1.be thereof, determines that the host country, in this case Albania, must notify of the detention their diplomatic representation of the sending state, in this case Russia, only if the detainees themselves request to contact their embassy.
We would also like to emphasize that the arrest or initiation of a criminal process against a person is personal data protected by the international convention to which Albania is a party. Even in this sense, giving the Russian embassy information about the detention of these citizens would be a violation of the international commitments of the Republic of Albania.
