The Chairman of the Democratic Party Parliamentary Group, Gazment Bardhi, has addressed an official letter to the Special Prosecution Office, presenting additional information regarding the complaint regarding the photovoltaic park at the Zadeja Dam, an issue for which he accuses the Deputy Prime Minister and Minister of Infrastructure and Energy, Belinda Balluku.
Bardhi has requested information on the progress of the investigations into this file, in which he says 5 million euros were stolen to the detriment of the state through inflated costs.
"The fight against government corruption requires only courage and professionalism from special prosecutors. Belinda Balluku's numerous affairs, which were carried out without any fear of the law, do not need much time to be discovered. SPAK itself has proven with concrete actions how the prices of procurement procedures are inflated to steal at double the cost. I have officially addressed SPAK not only to inform them that the Zadeja dam photovoltaic park affair is easily investigated, but also to inform us at what stage the investigations on this issue are. The open theft of 5 million euros cannot be dragged out or left in oblivion," says Gazment Bardhi in a Facebook post.
In December 2024, the Democratic Party sued Belinda Balluku in SPAK, accusing her of approving costs 3 times higher for the photovoltaic plant at the Zadeja dam.
Gazment Bardhi's full letter to SPAK:
Dear Mr. Head of the Prosecution Office,
With the letter dated 04.11.2024, received by you on 06.11.2024, we have forwarded information on the initiation of criminal prosecution against citizen Belinda Balluku, acting Deputy Prime Minister and Minister of Infrastructure and Energy. Specifically, the information forwarded related to the public procurement procedure "Construction of the photovoltaic plant at the Zadeja Dam", for which on 14.08.2023, the Albanian Electric Power Corporation ("KESH" sh.a.), has concluded a contract worth 812,702,500 lek ~ 8.13 million euros or 97% of the limit fund.
This procurement procedure raised strong suspicions of abuse and illegality, as the contracted offer from KESH sh.a. for 1 MWp at the Zadeja Dam is 98,509,000 lekë ~ 985,000 euros per MWp. Meanwhile, the economic offer from the same implementing and bidding company for another project with even higher technical requirements, financed with non-public funds, is 365,000 euros per MWp or 620,090 euros less than the contracted value from KESH sh.a. So, if the project "Construction of the photovoltaic plant at the Zadeja Dam", with a capacity of 8.25 MWp, were to be built at the same price that the same company has contracted in the private sector, this project would be worth 8.25 MWp x 365,000 euros = 3,011,250 euros or 5,115,775 euros less than the value of the contract concluded by KESH sh.a. Meanwhile, the second commercial offer for a 10 MWp installation given by the same company results in a value of 375,000 euros per MWp, which means that if this price were applied to the contract with KESH sh.a., then the value of the contract would be 3,093,750 euros or 5,033,275 euros less than the value of the contract concluded by KESH sh.a.
The fictitiously inflated costs have caused a damage of 5 (five) million euros to the State Budget, for which damage citizen Belinda Balluku, acting Minister of Infrastructure and Energy, and citizen Ergys Verdho, acting administrator of KESH sh.a., although they were fully aware of the large price difference between the public and private sectors because every project for the construction of new production capacities is submitted to the MEI, with full awareness and intent have allowed the occurrence of a serious economic damage to the State Budget, bringing illegal benefits to private entities that have entered into a contract with KESH sh.a.
In fact, the fictitiousness, illegality and abuse in this public procurement procedure are also proven by a procurement procedure carried out by the Special Prosecution Office against Corruption and Organized Crime for the construction of a photovoltaic plant for its own needs on the terrace of this institution with an installed power of 180 kWp, with a limit fund value of 80 thousand euros, or 444.4 euros/kWp (attached contract notice, terms of reference and technical specifications). Meanwhile, in the public procurement procedure “Construction of a photovoltaic plant in the Zadeja Dam”, 1 kWp was contracted for 985 euros (540.6 euros more than the price procured by SPAK), which means that the 180 kWp capacity cost the State Budget 177,300 euros. So, for the same installation capacity of 180 kWp, between the procurement carried out by SPAK and the procurement carried out by MEI there is a difference of 97,300 (more than double the value). If the public procurement procedure “Construction of the photovoltaic plant at the Zadeja Dam”, had been carried out by SPAK, then the total cost would have been 8250 kWp x 444.4 euros = 3,666,300 euros or 4,463,700 euros less than the value of the contract concluded by KESH sh.a.
This difference of about 4.5 million euros constitutes a clear damage caused to the State Budget by the actions and inactions contrary to the law of citizens Belinda Balluku, acting Minister of Infrastructure and Energy, and Ergys Verdho, administrator of the public company KESH sh.a.
Therefore, considering the above, in support of Articles 75/a, 280 and 281 of the Criminal Procedure Code, we request from the Special Prosecution Office against Corruption and Organized Crime that this additional information, together with the relevant documentation, be made part of the investigative file, and in support of Article 110 of the Criminal Procedure Code, that we be informed regarding the progress of the report of 4.11.2024 submitted by us, including the investigative actions carried out so far and the current status of the criminal proceedings.
