The trial for former prime minister Sali Berisha will be held today. Berisha's defense side requested the exclusion of judge Irena Gjoka from the process a day ago, submitting the evidence that, according to them, proves the fact of her dismissal in February 1996 from the KLD where Sali Berisha was the president.
In the meantime, the court session at GJKKO will start at 11:00, where SPAK's request for toughening the measure against Berisha, from having to appear under house arrest with police supervision, will be examined.
Request
After the approval of the authorization by the Assembly for the removal of Sali Berisha's freedom, SPAK addressed the Court on December 22, requesting the tightening of security measures for the former prime minister, who is being investigated under suspicion of corruption in the privatization of the former sports club "Partisan".
In the request addressed to GJKKO, the Special Prosecutor's Office requests the measure of "house arrest". The law gives the Court 5 days to consider SPAK's request, and judge Irena Gjoka is expected to call the parties in Tuesday's court session to hear the parties, on the one hand SPAK prosecutors and on the other hand the person under investigation Sali Berisha and his lawyers.
Respecting Christmas Day, the session at GJKKO takes place on Tuesday, after the Assembly cleared the way for SPAK to arrest deputy Sali Berisha, as a coercive measure against him, since earlier, the former prime minister refused to implement the decision of the special court, which had determined the measure of the obligation to appear and prohibition to leave the country. In the plenary session of December 21, the Assembly, amid tensions, voted to grant authorization to SPAK.
SPAK turned to the Special Court, after Sali Berisha contested the first decision to oblige him to appear, considering it unconstitutional. In Berisha's legal and constitutional opinion, the initial measure in charge of him could not be implemented, since SPAK had not previously received authorization from the Assembly. But SPAK remained of the opinion that the measure to compel appearance was of a character that is considered a restriction and not a deprivation of liberty.
The 'fight' for the stamp of the DP
The High Court is expected to hold a hearing today on the recourse that Sali Berisha's Reestablishment group has filed for the decision of March 3, where the General Appeal returned the issue of the logo and seal of the Democratic Party to the first instance. The case will be examined by judges Artur Kalaja, Ervin Pule and Dariel Sina at 09:00.
In March of this year, the Court of Appeal decided to overturn Agron Zhukri's decision and to return the case for review at first instance with another panel. After this decision, the seal, sigla, logo of the Democratic Party remained the official PD.
With complete unanimity, the Appellate panel, composed of relator Elona Mihali and members Astrit Kalaja and Irida Kacerja, annulled the decision of March 25, 2022.
