Former Prime Minister and PD Chairman Sali Berisha says that Bajram Begaj's candidacy for President of the Republic is a violation of the Constitution.

In a reaction on Facebook, Berisha writes that the Constitution prohibits the appointment of active military personnel to other positions.

SALI BERISHA'S FACEBOOK REACTION:

Dear friends, the proposal of the Chief of General Staff of the Albanian Army for the post of President of the Republic is a flagrant violation of the Constitution of the country with very serious consequences for the present and the future of the country.

Article 167 of the Constitution of Albania stipulates that “Servicemen of active service may not be elected or appointed to other state positions, nor participate in political parties or activities. "Members of the armed forces or persons performing alternative service shall enjoy all constitutional rights and freedoms unless otherwise provided by law." 

This article therefore strictly prohibits active-duty military personnel from being elected or appointed to other positions. Therefore, this appointment is unconstitutional and dangerous for the present and the future of Albanian democracy.

This serious violation of the Constitution plunges the country into a serious constitutional crisis.

This is the first time that the Constitution in its precision is clear as crystal and it is taxing in its article that the active military can not be appointed and elected to other duties outside the Army.

He who believes that he can sell General Bajram Begaj as an inactive soldier mocks the Constitution, the Army and the Albanian society. General Begaj, who even at this moment is the Chief of General Staff, ie active, is resigning or being dismissed by decree, so he is leaving the Army as an active military precisely to be appointed to a task that the Constitution does not allow.

Do te ishte antikushtetuese, e turpshme dhe jashte çdo llogjike ligjore te shpallje ushtarak jo aktiv ate qe kalon nga karrigia me e larte e Ushtrise ne karrigen me te larte te shtetit. Ne rast se gjeneral Begaj kishte ambicie politike, ai duhet prej kohesh te kishte hequr dore nga funksionet ushtarake.

Per qendrimin e tij te dy diteve te fundit ai provon se nuk njeh ligj as Kushtetute per ambiciet e tij per pushtet ndaj dhe duhet larguar urgjent nga Ushtria si preson i rrezikshem per vendin.

Miq, Kushtetuta ne nenin e saj 167 eshte taksative me qellim qe ushtaraket  per kohen qe jane ushtarak aktiv nuk mund te kene, ushqejne ambicie per pushtete te tjera.

Me kete akt antikushtetues krijohet precedenti teper i rrezikshem per vendin sepse krijon precedentin e mundesise se ardhjes se ushtarkeve ne pushtet pavaresisht se kushtetuta nuk i lejon ata.

Just like today Bajram Bega, tomorrow a successor of his can use this constitutional precedent to usurp even the head of state.

I strongly condemn this typical act for the junta and unprecedented in the history of free countries.

I condemn this act as flagrant evidence of the seizure of the state and the Constitution by a criminal organization led by Edi Ramen, which has no other interests than the theft and robbery of citizens.

I call on the President of the Republic to protect the Constitution and not to allow this flagrant and extremely dangerous violation of it. sb
