Italy has approved the concreting of one of the most protected stretches of coastline in the Mediterranean. On 4 June, the Council of Ministers rejected the formal objection presented by the Autonomous Region of Sardinia and the Ministry of Culture, reactivating the single authorization issued earlier, in February, by the ZES Mission Structure for the gigantic “Tavolara Bay” project, in the municipality of Loiri Porto San Paolo, in the province of Sassari.

The project envisages the construction of a luxury complex, as a prelude to a wider plan that includes a five-star hotel, dozens of villas, restaurants, a marina, a heliport and a golf course. The entire project will be built overlooking the Tavolara–Punta Coda Cavallo Marine Protected Area, created in 1997 and protected on several environmental levels, in an area where the Sardinian Regional Landscape Plan prohibits any construction within 300 meters of the coastline.

The government acted by ignoring the binding negative opinion of the regional office of the Ministry of Culture for the protection of heritage, the opposition of the Autonomous Region and the remarks of the Ministry of Culture itself. For this, a rule was used designed to simplify investments in southern Italy, not to avoid the protection of the landscape in a region with a special statute.

Group and project

The operation is being led by JHSF, a Brazilian real estate and tourism giant headed by José Auriemo Neto. In 2007, JHSF acquired a majority stake in the Fasano hotel group, founded in 1902 in São Paulo by Lombard immigrant Vittorio Fasano. Since then, JHSF has built a luxury hospitality empire that stretches from Rio de Janeiro to New York, from London to Miami, from Cascais to Punta del Este.

Sardinia marks the group's first foray into Europe. Last summer, Fasano Al Mare Beach Club in Cala Finanza was already discreetly opened to select guests. The rest of the project, designed by Brazilian architect Isay Weinfeld, is expected to be completed by 2028.

According to documents from Gruppo d'Intervento Giuridico, an environmental legal organization, the development affects about 50 hectares of coastal land between Cala Finanza and Punta La Greca, as well as dozens of other hectares inland. According to Gian Antonio Stella reporting in Corriere della Sera, the planned hospitality structure in the first phase alone would occupy 4,350 square meters.

Approval process and objections

Më 4 qershor, Këshilli i Ministrave hodhi poshtë të gjitha kundërshtimet, duke riaktivizuar autorizimin.

Këto janë rregulla që nuk mund të tejkalohen përmes një konference shërbimesh të parashikuar nga një ligj kombëtar që nuk mund të mbizotërojë mbi kompetencat e Rajonit”, tha ai.

Rajoni dhe gjykata administrative

Presidentja Alessandra Todde reagoi me një deklaratë të prerë: “Ligjet e Sardenjës nuk mund të anashkalohen. Ne do t’i mbrojmë plotësisht prerogativat e autonomisë sonë.”

Sipas Todde-s, thjeshtimi administrativ nuk mund të përkthehet në dobësim të kompetencave që u janë dhënë rajoneve me statut të posaçëm, as në ulje të garancive që mbrojnë territorin. “Bregdetet tona janë identitet, mjedis, ekonomi e qëndrueshme dhe e ardhme”, shtoi ajo.

The region has already filed an appeal with the TAR, the Regional Administrative Court. On June 6, the presiding judge rejected the request for a preliminary suspension. The company had officially stated that it would not start any ground-altering works throughout the summer of 2026, thus removing the urgency that would justify such a measure. The collegial hearing on the suspension is scheduled for July 8.

Parliamentary front

The issue has already reached Parliament. Sardinian deputies and senators from the Five Star Movement have announced that they will raise the issue at all possible institutional instances, asking the government to explain why it ignored the negative opinions.

Francesca Ghirra, an MEP from the Alliance of the Greens and the Left, has already tabled a parliamentary question to the ministers for the Environment, Tourism and Cohesion Policy. “The use of the simplified procedures provided for by the ZES to circumvent the existing territorial and landscape planning of the island is unacceptable,” she said.

On July 8, at the TAR of Cagliari, the first real judicial test will begin. But for Cala Finanza, the Region and environmentalists warn that this is just the beginning of a battle that could reach the Constitutional Court.

This is not an isolated case in the Mediterranean. In Albania, in recent days, thousands of people have taken to the streets of Tirana against a luxury resort worth over $1 billion, promoted by a fund of Jared Kushner, Donald Trump's son-in-law, in protected areas of the Adriatic coast. The same logic, the same scenario, but the protests have been going on for over two weeks now with thousands of citizens on the streets and have turned into a broader anti-government movement demanding the resignation of Prime Minister Edi Rama.

This case highlights broader tensions between investment-driven development and environmental protection in highly sensitive coastal regions globally.
