Court in Kosovo: Politician Ivanovic was killed for not submitting to the Serbian List, organizer Radoićić and the Serbian state

The Basic Court has found Milan Radoi? responsible for the murder of former Kosovo Serb politician Oliver Ivanovi?, while four defendants have been sentenced to over 22 years in prison.

The foundation finds that the former deputy leader of the "Srpska" List led an organized criminal group that organized the murder on January 16, 2018 in North Mitrovica and took actions to destroy evidence to hinder the investigation. The group had a clear structure, criminal and political influence, operated with the support of the Serbian state and exercised blackmail against political rivals, including Ivanovic, who refused to submit to their demands.

The Basic Court in Pristina has compiled the full written verdict against Nedeljko Spasojevic, Marko Rosic, Dragisa Markovic and Zarko Jovanovic, accused of the murder of Serbian politician Oliver Ivanovic, who on June 28, 2024 were sentenced to over 22 years in prison together.

The verdict provided by the “Oath for Justice”, which was signed by the presiding judge, Valon Kurtaj, states that the defendants were part of an organized criminal group that has been operating for a long time in northern Kosovo, under the leadership of Milan Radoi?i? and Zvonko Veselinovi?, who are wanted by the justice authorities in Kosovo. Radoi?i? is also accused in the case of the terrorist attack in Banjska.

"From these proven facts, the existence of this organized criminal group has been proven, that it had an organizational structure headed by Milan Radoicic, and that this criminal group, in addition to control in the criminal field, also had control in political life. Being involved in the structures of the party "..." and preventing any political rivalry, up to the murder of the now deceased I., since he did not submit to the demands of this group that he also politically join this group and give up the electoral campaign as a single party, a request of state structures from Serbia," the verdict states.

It is further emphasized that this group has organized not only the murder of politician Oliver Ivanovic, but also the disappearance of evidence in the case, with the aim of sabotaging the investigations of the authorities of the Republic of Kosovo.

According to the verdict, in the northern part of Mitrovica and the surrounding municipalities, there was a fragile security situation and a climate of political threats and blackmail exercised by the criminal group under the control of Milan Radoi?i?. This group was not only involved in criminal activities, but also had great political influence, aiming to eliminate any rival political entity of the Serbian List, an entity which, according to the evidence mentioned in the verdict, enjoyed direct support from the Serbian state, the “Oath for Justice”, reports Klankosova.tv.

Witnesses mentioned in the verdict, including DS, KB, MI, CI, VN, HN, SJ and RR, have confirmed the existence of this criminal group, as well as the danger that Oliver Ivanovic faced due to his political beliefs and positions.

It states that Ivanovic was killed on January 16, 2018 in North Mitrovica, at around 08:14, by executioners of this criminal group. His murder is considered the result of political rivalries, as he had not submitted to the demands of this group to stop the campaign and join the political line of the Serbian List.

The court considered it a proven fact that this criminal group had a well-organized structure headed by Milan Radoi?, and that its influence extended both to the underworld and to the political life of the Serbian community in northern Kosovo.

According to the decision of the Basic Court in Pristina, a rejection verdict was issued for the accused Rade Basara, after the Special Prosecution of the Republic of Kosovo in its closing statement dropped the indictment against this accused.

For the accused Silvana Arsovic, according to the SPRK's claims, from the examination of the DVR from the party offices of the now deceased Ivnovi?, it was confirmed that on 04.01.2018 the security cameras were deliberately blocked by unknown persons, while on 16.01.2018, after the murder of the deceased, they were reactivated and started filming at the scene of the crime. Based on the Prosecution's conclusions that the accused was alone in the office at that time, it was assumed that she activated the cameras after committing the criminal offense.

However, the Court has established that, although an organized crime exists and the elements of this crime have been met, there is no evidence linking Arsovic to this group. “The Special Prosecution, with regard to the accused, has not proven with any evidence that she was part of this organized criminal group…”, the Basic Court’s judgment states.

For Nedeljko Spasojevic, the court has reclassified the criminal offense from organized crime to abuse of official position, for which he was found guilty and sentenced to 4 years and 6 months in prison. The court found that he was present at the scene of the crime, but did not take the necessary actions to secure the scene.

He was also found guilty of the criminal offense of unauthorized control or possession of weapons, with evidence based on the seizure of weapons in his home.

For Dragisa Markovic, the court assessed that the criminal offense of revealing official secrets was not proven, since the information provided by him - "the deceased I was killed", was not classified as an official secret by any competent authority.

Meanwhile, for Markovic and Jovanovic, the court found that in their capacity as police officers they did not take all necessary actions at the scene of the crime, allowing the destruction of evidence and the intervention of unauthorized persons. Zarko Jovanovic was also found guilty of unauthorized possession of weapons.

In the case of Marko Roshi?, the Court found that he was an active part of the criminal group, participated in the burning of the victim's car and followed his movements with his personal vehicle, thus contributing to the commission of the murder.

The court stressed that Ivanovic's murder was carried out by a criminal group due to political rivalries and attempts to expand political power.

The Basic Court in Pristina on June 28, 2024, announced a guilty verdict against Nedelkjo Spasojevic, Marko Rosic, Dragisa Markovic and Zarko Jovanovic, who were sentenced to over 22 years in prison.

According to the indictment, the defendants Nedejklo Spasojevic, Marko Rosic, Rade Basara and Silvana Arsovic are accused of having, in collaboration with the defendants ?eiko Bojic, Zvonko Veselinovic and Milan Radoicic, who are on the run, and two other unknown defendants, acting as a criminal group with the aim of extending control over the northern part of Mitrovica, both in political and economic life and the general activity of the organized criminal group, having acted intentionally and knowingly to commit the criminal offense of aggravated murder, where each of the defendants on the critical day when the murder of the now deceased Oliver Ivanovic occurred, committed specific incriminating acts for the purpose of the group in question, in which case, as a result of the actions of this organized criminal group, the murder of the now deceased Ivanovic occurred.

The accused Dragisa Markovic is charged with “Disclosure of official secret” under Article 433, par. 2.1 of the Criminal Code. Markovic, together with Zharko Jovanovic, is also charged with “Abuse of official duty in complicity” under Article 422, par.1 in conjunction with par.2, subpar. 2.2 in conjunction with Article 31 of the Criminal Code.

The accused Jovanovi? is also charged with the criminal offense “Unauthorized ownership, control or possession of weapons” under Article 374, paragraph 1 of the Criminal Code. The accused Nedeljko Spasojevi? is also charged with the criminal offense “Unauthorized ownership, control or possession of weapons” under Article 374, paragraph 2 in conjunction with paragraph 1 of the Criminal Code.

Meanwhile, on December 27, 2023, the Special Prosecution Office of the Republic of Kosovo (SPRK) filed an indictment against Milan Mihajlovic in connection with the murder of Ivanovic, charging him with four criminal offenses. /Oath for Justice
