On September 28, 2017, a control group of the Customs Directorate inspected the deposits of the Bankers Petroleum company in Patos-Marinze after receiving complaints that the company was evading taxes by not declaring oil thinners.

The documents obtained exclusively by Voxnews.al show that the inspection showed that the denunciations were correct. The company had avoided excise duty on thousands of liters of diluent. The damage caused to the state budget by the missing taxes was about 3 billion lek, or 25 million euros at today's exchange rate.

The Directorate of Excise Controls started the procedures for fining the company, according to legal provisions. Article 87 of the law on excise duties stipulates that the fine in such cases is three times the damage caused. Simply put, the fine that was imposed was 9.4 billion lek, or 80 million euros in total at today's exchange rate.

At the beginning of 2019, the Directorate of Controls and Excise informs the customs branch of Fier about the amount of the fine, according to legal provisions. But the fine was not executed even then and has not been executed yet.

Bankers decided to challenge the fine in the courts. The first two levels of justice ruled in favor of the company. The company's complaint was used as an argument by the government in 2019 to justify not collecting the fine.

Three years later, in April of this year, the Supreme Court overturned the decisions of the two lower courts and upheld the fine, which together with late interest and other penalties added to it has reached almost 100 million euros.

The decision of the Supreme Court is the removal of any barrier that the institutions had for the execution of the fine and the collection of a sum of money, so necessary for the government in this period of price crisis.

However, for seven months the institutions have been silent and have not publicly made any effort to collect the fine. Sources of Voxnews.al claim that the decision of the Supreme Court has officially arrived at the Customs Directorate, as a party to the judicial process. The Bankers company has also been informed of the decision.
