The decisions of the arbitral tribunals are binding on all parties that have signed the World Bank Arbitration Convention. Albania has signed this convention, which means that it must respect the given decision. But there are cases when the decision can be rejected, citing the right of sovereignty. Deputy Prime Minister Belinda Balluku also taught this idea.

The World Bank Arbitration itself has no enforceable means of enforcing awards. His only recourse is to contact the losing party to obtain information on the stage of execution of the decisions he gives.

The issue is that in such cases, the winning party in the Arbitration, in the case of Albania Francesco Becchetti, has the right to demand the enforcement of the decision in other member countries of the World Bank Arbitration Convention.

Becchetti tried to achieve this before the decision took a definitive form, through lawsuits for the identification and blocking of Albania's assets in European countries, starting from the Netherlands, Belgium and Austria. The court of these countries initially gave them the right, but then suspended the execution of the decisions after they recognized Albania's request to the Arbitration for review and cancellation of the fine.

Now this obstacle does not exist and Becchetti has his hands free legally to block the assets of the Albanian state around the world.

This could be his move after this decision, based on the position of the Albanian Government which said this Wednesday that it can apply the right of sovereignty, as the British government did earlier.

However, even though it says it will not pay Francesco Becchetti a penny in this year's budget, the Ministry of Finance has earmarked a fund of 176 million euros as bills for arbitration courts. According to the budget, 60 million euros are considered lost, while the rest of 116 million euros are contingency funds for ongoing trials, one of which at the time the law was drafted and voted was the one with Becchetti.
