The public company Albanian Seaport Development, a partner in the 2 billion euro project of Durrës Yachts & Marina, has ended up in the Public Procurement Commission in recent days after a complaint about a procurement procedure made by an economic operator.

In the listing made on the website of the Commission, it is clarified that the contested tender concerns the purchase of informational/electronic equipment with a limited fund of 5.2 million ALL.

The complaining operator claims that the criteria set in the procedure in some cases do not match and should be corrected and in others are exaggerated. Thus, first the operator has requested to correct the criterion for authorizing the manufacturer, which according to him is discordant and creates confusion among operators.

Another criterion related to the employees of the company with detailed specifications is considered unsubstantiated and exaggerated since in this case it is being requested to buy equipment and not consultancy.

"While the CA does not seek to contract consultants for the identification of IT business needs in IT management or process optimization. The object of the procurement procedure is the purchase of electronic devices and their sale at the premises of the CA and nothing more. Therefore, the request for equipment with CompTIA certifications of any kind is meaningless, as they are not necessary to guarantee the implementation of the contract", the document states.

The operator argues that the criteria must be related to the object of the procurement and be proportional. The CA cannot establish unnecessary tender criteria for the realization of the contract, criteria which cannot be argued legally and technically with the need for the realization of the contract, thus violating the principle of proportionality in establishing the criteria.

In the ranking, several requests were made for corrections of criteria that, according to the operator, are necessary in order to avoid criteria that create restrictions on competition.

Albanian Seaport Development Company

Albanian Seaport Development was registered last year and the shareholder of 100 percent of the shares is the Durrës Port Authority. The company in question is the one that has entered into an agreement with companies from the Emirates that will develop the Durrës Yacht&Marina project.

The framework agreement was signed last year with the law no. 79/2022, "For the approval of the framework agreement, between the Council of Ministers of the Republic of Albania and Eagle Hills Real Estate Development" sh.pk, "Albanian Seaports Development Company" sh.a. and SME Developmentl.lc, regarding the strategic investment project "Durres Marina & Yachts".

The parties have established a joint company (33% through the Albanian Seaports Development Company) and two companies from the United Emirates (Eagle Hills Real Estate Development, sh.a., and Nshmi Development LLC", with 67% together).

The Albanian state has entered into this agreement with its contribution to the land. In March 2023, 281 properties were transferred to the administration of the Albanian Seaport Development company for the development of this strategic investment./ Monitor
