Criminal proceedings for non-payment of taxes are doubled. Profile of defendants and their geography

The number of criminal proceedings for entities that have not paid taxes and duties throughout 2023 has doubled compared to the previous year. In the annual report of the General Prosecutor's Office filed in the Assembly, it is evident that for this group of crimes, in the requests related to the type and amount of punishment requested, it results that for about 77.2% of the defendants, a prison sentence was requested.

The specific weight of the criminal offense "Non-payment of taxes and taxes", in the group of criminal offenses "Criminal offenses related to taxes and taxes" is 18.18% for 2023, while in 2022 it was 9.90% . From the statistical data, there is an increasing trend in the proceedings registered in 2023 for the criminal offense provided for by Article 181 of the Criminal Code "Non-payment of taxes and duties", of 9.68% compared to the proceedings registered in 2022.

In the analysis of the data, it results that the profile of the defendants turns out to be almost 88% male, 60% have secondary education, 97.7% are employed in the private sector and 3.85% are convicted of other works.

As far as social geography is concerned, the highest number of proceedings for criminal offenses related to taxes and duties was registered in the Prosecutor's Office at the Court of First Instance in Tirana with 29%, while the highest coefficient per 100,000 inhabitants results in the districts Vlora with 21 proceedings and Shkodër and Gjirokastër districts respectively with 11 proceedings each.

The court decided in 76% of the sentences, a prison sentence and in 23.91% a fine sentence, in the meantime it decided 6 dismissals and 13 acquittals.
