If the tender of State Police uniforms with a value of 2.8 billion ALL had to be further investigated, for SPAK this was an issue that should be resolved by the capital's prosecutor's office, but for the latter it was a file where no traces of crime were found.
In the decision placed at the disposal of the TCH, it appears that the Tirana prosecutor's office also closed the investigation on a part of the sensational file of the police clothing scandal with the argument that there was no criminal offense.
During an investigative process at the SPAK, the operators' union was not included in the ten final guilty verdicts for violation of equality in tenders, which according to Jani Gjergjefi's report, thousands of defective police uniforms were returned to the operators' union, despite the fact that technical details were specified in the agreement along with the quantity of 9638 pairs of pants and 548 skirts.
After SPAK declared incompetence and handed over the case to the capital's prosecutor's office, the latter also closed the investigation for fraud charges with serious consequences, but also for the exercise of illegal influence.
The highest official convicted for the tender of uniforms was Edlira Naqellari, who was the director of the centralized purchasing agency.
Naqellari, together with the members of the procurement unit found guilty, did not accept the charges, although the merger of the operators according to SPAK was found to have deficiencies in the documentation. all former officials of the Ministry of the Interior and former police officers have completed their sentences and left prison.
But neither the special prosecutor's office nor the one in Tirana was able to prove the charges against the company that produced the state police uniforms.
The Prosecutor's Office of Tirana elaborates that it has carried out a series of investigative actions, including that it has questioned the accused, but also that it has seized the decisions of the civil courts for the establishment of companies. For this reason, there is no conviction that they should be placed under investigation, the capital's prosecutor's office declares. However, it is the court of Tirana that will decide whether to accept the request for dismissal of the case, or send it back for further investigative actions.
