Voice of America: Why "house arrest" is required for Sali Berisha!
Sali Berisha

In Albania, the Special Prosecutor's Office against Corruption and Organized Crime turned to the parliament today to obtain its authorization for the arrest of former Prime Minister Sali Berisha.

The request follows the former prime minister's refusal to comply with a Special Court order barring him from moving abroad and requiring him to appear twice a month (first and third Friday) before a judicial police officer.

The Code of Criminal Procedure provides that when a security measure is not applied, " the Court may impose another more severe measure ", which in this case would be "house arrest", for which the authorization of the parliament is mandatory.

In the letter sent to the parliament, the head of the Special Prosecution, Altin Dumani, did not define the requested measure, talking about the replacement of the previous measure with "prison arrest/house arrest".

Mr. Berisha had described the court's decision on "obligation to appear before the judicial police" and "prohibition of movement abroad" as a "flagrant violation of the Constitution" and for this reason he made it clear several times that he did not he intended to implement it. Even today he said that "in that case I defended the Constitution and not myself".

As for today's request of the Special Prosecutor's Office addressed to the parliament, he clearly stated that "any decision, after the authorization of the parliament, I will respect without any discussion".

That is why Mr. Berisha has not been charged. He is under investigation on suspicion of "corruption" in the case of the privatization procedures of the former Partizani sports club, where his son-in-law Jamarbër Malltezi was one of the owners of the land on which a complex of buildings was later erected. Mr. Malltezi was initially arrested, but then released under house arrest.

The former prime minister rejected the prosecution's claims, while describing his son-in-law as a "political prisoner"./ VOA
