Former Minister of Justice Ylli Manjani

Former Minister of Justice Ylli Manjani says that messages from SKY ECC applications or other similar encrypted platforms cannot be used as evidence by the court.

In the studio of the show "Breaking" on Top News, Manjani also commented on the order of the Minister of the Interior, Taulant Balla, who warned police officers who have used encrypted applications to be excluded from the ranks of blue uniforms.

According to Manjani, the use of SKY applications, or Encro Chat, is the same as any other communication application such as WhatsApp or Viber, and there is no way it is illegal.

"The users of these platforms are platforms that people use freely in the market, for private communications, it is their business why they use them. If we want to answer the question of whether it is illegal to use them, the answer is no, it is not illegal. Only if there is a rule that does not allow you to use other phones than the one given to you by work, and this is an ethical violation, not a criminal one," said Manjani, among other things.

Former minister Manjani said that the interception and collection of data from these applications was done by the French authorities after the passage of a special law, and was used to undertake concrete actions against criminal groups. But the messages themselves, according to him, have no way of constituting evidence for the incrimination of the user.

"A group of people are placed under arrest, and they get acquainted with the decision of the GJKKO, which tells them that, in short, some communications were discovered about you on a platform called "SKY" and you said this and that. And he goes to the courtroom to face them. In the courtroom they are secret, we don't know who takes them out. In 2012, France passed a law allowing investigative authorities to obtain information from private, encrypted, but not necessarily illegal, platforms. And on the basis of the wards they have intervened in these platforms. They have produced a device that will intercept these applications. Even SEE, the CIA do these, they go into these platforms to see what happens. They hacked this platform, they hacked this platform, and they hacked this platform in real time. Now, this database that they have created, the communicators of these platforms are not names, they are codes, you send a message from a code to a code, the message is encrypted on the way and is deleted for 90 seconds.

In Albania, our BKH took it and divided it according to the codes, and SPAK started the criminal process. They sent a letter of order from SPAK to France and it is a CD that through this tells us that there are some conversations there, but who they are and why they are there. Well, how did you make sure that these conversations belong to these people? Because you didn't catch the camera red-handed. The standard of the convention is that I can go into the courtroom and say I killed so-and-so. It is not enough, it has to be proven", said Manjani.
