Murder of Martin Cani/Mario Përlleshi requests replacement of security

The Court of First Instance in Tirana has decided to extend the security measure of "prison arrest" for M. Përlleshaj, the suspected perpetrator of the murder of Martin Can.

Përlleshaj requested that his security measure be changed and that he be under “house arrest”. The 14-year-old is in the juvenile institution in Kavajë, while in December 2024 he also opposed the security measure of “prison arrest”. The minor Martin Cani was killed on November 18 a few meters from the “Fan Noli” school in Tirana.

Referring to media interest, the Court of Appeal of General Jurisdiction informs as follows:

Upon the request of the Prosecutor's Office at the Court of First Instance of General Jurisdiction in Tirana, a trial was held regarding the "Two-month information for the minor in conflict with the law, regarding the implementation of the security measure "arrest in prison", where the legal representative of the minor in conflict with the law requested "the replacement of the security measure "arrest in prison", suspected of committing the criminal offense "Murder committed in qualifying circumstances", provided for by Article 79 letter "a" of the Criminal Code.

At the end of the trial, the Court of First Instance of General Jurisdiction of Tirana, with decision no.…. act, dated 23.01.2025, has decided:

-Rejection of the minor's request in conflict with the law "...", with the object of replacing the personal security measure.

-Continuity of implementation of the personal security measure "arrest in prison" against minors in conflict with the law "...".

The appeal case was reviewed on the basis of the complaint filed by the minor in conflict with the law, citizen “…, who requested the amendment of the decision of the First Instance Court of General Jurisdiction of Tirana, the replacement of the security measure from “prison arrest” to “house arrest”. At the end of the trial, today on 10.02.2025, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Ms. Elona Mihali, decided:

– Approval of decision no.…. act, dated 23.01.2025 of the Court of First Instance of General Jurisdiction of Tirana.
