Former MP Monika Kryemadhi has requested the Special Court (GJKKO) to declare the whitelisted records from her mobile phone, which was seized during the investigation, unusable.
In the court hearing, Kryemadhi claimed that the data from her phone was obtained illegally, as at the time the seizure was carried out, she held the mandate of an MP.
According to her, evidence obtained in violation of legal procedures cannot be used in the judicial process.
"The cell phone was seized illegally. At that time, I was a member of parliament and illegally obtaining evidence makes it unusable," Kryemadhi is reported to have declared before the court.
Her reasoning is that despite the fact that she informed the BKH agents that the seized cell phone was hers, they seized it anyway.
"The prosecution should not have come to search my apartment, since I was a member of parliament. The prosecution knew that we lived in the same apartment. The prosecution knew that, when the search was conducted, my bedroom was searched, despite the fact that it was in the name of Fatime Kryemadhi," she said.
