The Special Court has granted SPAK the right to dismiss the case of Jonaid Myzyri and other defendants for violations with a tender worth 2.2 million euros.
The decision was given by Judge Paulin Çera who accepted the request of Prosecutor Elvin Gokaj.
After the GJKKO gave SPAK 45 days to review an expert report, which would be conducted by licensed experts, the Special Prosecution Office came with the same request for a recess, a request that was accepted by the court.
Just like for Myzyri, SPAK had requested the suspension of the investigations for KPP members Vilma Zhupaj, Lindita Skeja, Merita Zeqaj and Enkeleda Bega.
Jonaid Myzyri was investigated for a two-year period by the prosecution under suspicion that the institution he headed committed violations in connection with a tender procedure worth around 2.2 million euros carried out in 2020 for the maintenance of the Rrëshen (Fanit Bridge)-Shpal, Shpal-Qafë Bene-Hadroj and Shpal-Repsit Bridge road segments with a total length of 59 kilometers.
The proceeding body alleged that the KPP official, in violation of the law, favored the merger of the companies “AEK MUNELLA” and “DRINI-1”, which won the tender with false documents. In this process, there were complaints from other operators, such as “KTHELLA”, disqualified by the commission on the grounds that the lowest value offer it had submitted was abnormal.
Despite the prosecution's preliminary suspicions, at the end of the investigation it was determined that Jonaid Myzyri was innocent.
