The Special Structure against Corruption and Organized Crime has clarified the questioning of the journalist Elton Qyno, in the framework of an investigation into the release of investigative secrets through the publication of interceptions from the "SKY ECC" application.

SPAK says that Qyno published the messages of the repentant justice Nuredin Dumani with still unidentified persons, although they have not yet been documented in procedural acts by SPAK, as well as other messages that SPAK has and are procedural acts of the preliminary investigation.

In SPAK, Qyno has refused to show the source of the information, according to the right of non-disclosure due to the journalist's profession.

As a result, SPAK has found and confiscated the two phones that he had left in a "Coffee Bar" near the SPAK building, as well as seized materials from his electronic devices in the office and apartment.

FULL STATEMENT OF SPAK:

The Special Prosecutor's Office is conducting investigations within the framework of criminal proceedings no. 75 of 2022, in which persons with high social risk are being investigated for serious criminal offenses and which have resulted in the murder of several persons, criminal offenses which were carried out in the form of special cooperation of the structured criminal group.

On 10.12.2023, articles written by journalist Elton Qyno were found to have been published on the audiovisual media website Ora News (oranews.tv), which refer to some communications made by persons who are subject to preliminary investigations. On 11.12.2023, the articles were also published by other media.

In the articles that were published by the journalist Elton Qyno, it was clearly established that the text and content of the conversations in these publications contained some parts of the communications that the associate of justice Nuredin Dumani made with some other people (unidentified until now by the investigations) in encrypted platform SkyECC, which are the subject of preliminary investigations.

From the verification of the publications of the above-mentioned articles, through the consultation with the data of the investigative acts of SkyECC communications available to the Special Prosecutor's Office, it emerged that the conversations made public in the media have not yet been documented in procedural acts by the Special Prosecutor's Office within of criminal proceedings no. 75/2022. Also, some of the writings evidenced in the media articles corresponded with the content of communications that Nuredin Dumani made with other users on the SkyECC platform (unidentified so far), communications that only the Special Prosecutor's Office currently has, as procedural acts of preliminary investigation.

Kjo situatë e prezantuar në media krijoi dyshime se mundet të ndodheshim para elementëve të veprave penale:  “Zbulimi i akteve ose të dhënave sekrete” dhe “Ndalimi i dhënies dhe i shpalljes së të dhënave në kundërshtim me ligjin”, të parashikuara përkatësisht nga nenet 295/a paragrafi (3) dhe 313/b pika (1) të Kodit Penal. Mbi këtë, Prokuroria e Posaçme filloi hetimet dhe regjistroi procedimin penal nr.245/2023, për kryerjen e dy veprave penale të mësipërme.

Nisur nga fakti se publikuesi i artikujve të mësipërm ishte Elton Qyno / gazetar, më datë 13.12.2023 ai u ftua për tu paraqitur në SPAK, për t’i marrë një deklarim në cilësinë e personit në dijeni të fakteve që përbëjnë objekt hetimi, ftesë që gazetari  iu përgjigj pozitivisht dhe u paraqit. Pasi iu bënë të njohura arsyet e marrjes në pyetje, siç dhe parashikimi i nenit 159 i KPP (e drejta e mos deklarimit për shkak të profesionit të gazetarit) iu kërkua të shpjegonte mbi mënyrën se si kishte siguruar akte hetimore që përbëjnë sekret hetimor, zbulimi i të cilave ndaj të tretëve përmes publikimit është i ndaluar nga ligji procedural. Po kështu, iu bë e ditur dhe domosdoshmëria që ka lindur për të identifikuar e gjetur dokumente ose akte në origjinal apo në çdo formë tjetër që ai i dispononte.

Shtetasi Elton Qyno është përgjigjur se burimi ka qenë konfidencial dhe nuk mundet ta deklarojë për shkak të sekretit që lidhet me profesionin. Në këtë rrethanë, gazetari deklaroi me shkrim se aktet e dokumentet që dispononte ishin sekret që lidheshin me profesionin e tij (parashikim i nenit 211 pika 1 K.Pr.P) dhe nuk mund t’i jepte. Duke e konsideruar këtë si të pabazuar dhe me synimin për të gjetur dokumente, prova materiale, gjurmë ose sende që i përkisnin veprës penale, ai u ftua nga hetuesit që t’i këqyrej telefoni/telefonat që kishte në përdorim, gjë që gazetari iu përgjigj negativisht.

Sjellim në vëmendje se Prokuroria e Posaçme, me urdhrin e datës 14.06.2022, ka urdhëruar ndalimin e publikimit të akteve procedurale për këtë procedim penal dhe ky akt i është komunikuar shtetasit Elton Qyno.

Me kërkesë të Prokurorisë së Posaçme, Gjykata e Posaçme e Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar me vendimin nr.501 datë 13.12.2023 dhe nr.502 datë 13.12.2023 vendosi lejimin e kontrollit personal të shtetasit Elton Qyno, lejimin e kontrollit të banesës dhe të zyrës së tij, në vendin e punës, Zyrat e TV Ora News. Në vendimin gjyqësor u lejua edhe sekuestrimi i të dhënave kompjuterike në sistemin kompjuterik në vendin e punës dhe në banesë të tij.

Pursuant to court decisions, the personal search yielded a negative result, no mobile phone was found; from the control in the apartment and in the work premises, documents and electronic items were found and seized, which are suspected to have traces of the criminal offense that is being investigated. Meanwhile, before midnight, with the help of special operational tracking devices, it became possible to find two mobile phones in a Coffee Bar located close to the SPAK Building, which, after being made available to him, were recognized by him as his stuff.

The two mobile phones, electronic devices and paper documentation were seized in compliance with the court's decision, to undergo further examinations. At the end of the actions ordered by the court and already executed, the journalist Elton Qyno left the premises of SPAK to his apartment. 

The Special Prosecutor's Office has carried out procedural actions in full accordance with the requirements of the Code of Criminal Procedure, as well as in implementation of decisions no. 501 dated 13.12.2023 and no. 502 dated 13.12.2023 of the Special Court of First Instance for Corruption and Organized Crime.
