The preliminary hearing for the Elbasan Incinerator file has been postponed. It is learned that the next session will take place on January 18, 2023.

On leaving the Court, the lawyer Saimir Vishaj stated that he will request the dismissal of the case for all the defendants of the Elbasan Incinerator file.

According to him, Mirel Mërtiri, for whom the court granted the security measure in absentia, underwent a judicial process in 2018 where he was declared innocent.

According to him, a second investigation on him contradicts the law, while he calls this process politically motivated.

Sajmir Visha: I represent Jonida Zeqon. What I want to say are two moments. In 2018, the Court of Elbasan investigated and judged the innocence of Mirel Mërtir.

This is a final decision. Article 7 of the judgment of the record of the criminal procedure prohibits the trial twice. So at the moment there is a final judgment of 2021.

The criminal procedure has been started on the basis of the reports of the political forces, I think that this process will be considered as a political process.

You cannot judge the same fact twice. It has been judged, all the invoices with which this incinerator was made in Elbasan have been issued, and it has proven innocent. In the next session, we will request that the case be dismissed, for all the defendants.
