Magistrates' Associations: From August 1, salaries will be calculated

The National Association of Judges, the Union of Judges and the Association of Prosecutors of the Republic of Albania declare that, following the expiration of the deadline set by the Constitutional Court and the lack of intervention by the Parliament, the decision on the method of calculating the salaries of magistrates is now directly applicable.

In a joint statement published this Monday, the three organizations recall that the Constitutional Court, with decision no. 15, dated February 17, 2026, accepted the request of the Union of Judges, also supported by the National Association of Judges, assessing that the legal changes approved in 2023 violated the financial status of magistrates through a hidden salary reduction.

According to the associations, the Constitutional Court had given the Assembly until July 31, 2026, to adopt legal amendments that would regulate the salary scheme in accordance with constitutional standards. However, they note that this deadline expired without the requested amendments being adopted.

The statement states that the Constitutional Court itself had foreseen the mechanism that would be implemented in the event of the Assembly's inaction. For this reason, according to the associations, from August 1, 2026, the salaries of magistrates should be calculated according to the formula that refers to the salary of a senior public administration official, in accordance with decision no. 35/2022 of the Constitutional Court.

The associations add that the same formula should also be applied retroactively for the period 1 April 2023 – 31 July 2026, as defined in decision no. 15/2026.

In conclusion, they state that they will monitor the full implementation of the Constitutional Court's decision and call on the responsible institutions to respect the constitutional obligations for its execution.

The debate is related to the amendments adopted in 2023 to the law “ On the status of judges and prosecutors ”, which, according to the Constitutional Court, led to an indirect reduction in the salaries of magistrates. In February 2026, the Constitutional Court repealed these provisions and ordered the Assembly to adopt a new formula for calculating salaries by 31 July 2026. The Court also determined that, if the deadline was not met, the formula based on the salary of a senior public administration official would automatically enter into force. According to the statement of the magistrates’ associations, since the Assembly did not intervene within the deadline, this formula is already in force and should also be applied to the salary differences for the period 1 April 2023 – 31 July 2026.
