4 thousand m2 of land at Uji i Tohte in Vlora are seized

The Vlora Prosecutor's Office seizes 3996.5 m2 at Uji i Ftohte, worth 1.2 million euros, it was acquired with forged documents

On 23/12/2020, the Prosecutor's Office at the Court of First Instance, Vlorë, registered the criminal complaint against citizen FM. According to the documents, it appears that the complainant is one of the co-owners of the land property, with an area of ​​300m2, located in the "Uji i Ftohtë" neighborhood, Vlorë .

From the verifications carried out by the complainant, it was established that a part of his property that he had registered, was recognized as the property of other persons, who had acquired it through a judicial process. The property in question is located near the "New York" hotel, near the tourist area where the second part of the "Lungo Mare" project is being built in the city of Vlora.

It turns out that the document of origin on the basis of which the persons in question acquired the ownership of the above property, is the "transcription note" dated 04/04/1942, in favor of RD, against the state treasury office, where the object of her is the purchase from him of a plot of land of 5 vretan, against the value of 1200 gold francs, registered in the register with no. 232/4, vol. 12, article 104, page 106. From the verifications carried out by the complainant at various institutions such as ASHK Vlorë, it turned out that the above document does not exist, but according to the serial number there is only 107 dated 04/14/1942 and article 108 date 20/05/1942.

The complainant requested the initiation of criminal prosecution with the claim that the above document could have been forged by the persons who had benefited from the above property.

From the investigations carried out after the registration of this criminal proceeding, from the analysis of the data administered for the needs of the investigation of this criminal proceeding; administration of relevant documentation; evidence related to the investigated fact; as well as the conclusions of the act of technical-graphic expertise carried out during the investigations, evaluating them in harmony and unity with each other, from our side as a proceeding body, we reach the conclusion that in this particular case we are facing the elements of the criminal offense of "Forgery of documents" and "Cleaning the proceeds of a criminal offense or criminal activity", criminal offenses provided by article 186/1 and 287 of the Criminal Code.

Rezulton e provuar, se trashëgimtarët e shtetasit G.D., konkretisht shtetasi A.D., ka falsifikuar dokumentin "NOTË TRANSKRIPTIMI" e datës 04.04.1942, në favor të R. D., kundër zyrës së thesarit të shtetit, përpiluar nga noter A. A.”, dokument i cili sipas aktit të ekspertimit tekniko-grafik me nr.12299 datë 07/10/2022 të kryer nga ana e Institutit të Policisë Shkencore Tiranë, rezultoi tërësisht i falsifikuar. 

Rezultoi e provuar se dokumenti i mësipërm i falsifikuar, është përdorur në proceset administrative dhe gjyqësore, konkretisht pranë Agjencisë së Trajtimit të Pronave Tiranë (2013); Gjykatës së Shkallës së Parë Vlorë (2016); Gjykatës së Apelit Vlorë (2018) dhe ka qënë dokumenti bazë dhe kryesor që ka shërbyer për njohjen dhe kthimin e pronës dhe që ka diktuar vendimarrjen e Gjykatës lidhur me pasurinë objekt gjykimi, me sipërfaqe prej 6480m2, nga të cilat 3996m2 ka rezultuar e lirë, ndërkohë që pjesa tjetër ka rezultuar e zënë me ndërtime.

Krahas falsifikimit të këtij dokumenti, rezultoi e provuar se pas vendimeve gjyqësore që kanë vendosur njohjen dhe kthimin e pronës, pasuria është regjistruar në regjistrat e pasurive të paluajtshme pranë ASHK Vlorë, me nr.43/189/1 pasurie, zk.8602, vol.95, faqe 247, me sipërfaqe prej 3996,5m2.

Më tej mbi këtë pasuri janë kryer veprime juridike me qëllim fshehjen/mbulimin e natyrës së paligjshme të pasurisë së përfituar me anë të dokumentave të falsifikuara

Në funksion të këtij procedimi penal, është kërkuar pranë Gjykatës së Shkallës së Parë Vlorë, caktimi i masës së sigurimit pasuror “Sekuestro Preventive”, lidhur me pasurinë e mësipërme, e cila është regjistruar pranë ASHK Vlorë mbi bazën e përdorimit të dokumentit të falsifikuar.

Me vendimin me nr.478 akti datë 03/11/2022, Gjykata e Rrethit Gjyqësor Vlorë, ka pranuar kërkesën e paraqitur nga ana e Prokurorisë pranë Gjykatës së Shkallës së Parë Vlorë, duke vendosur masën e sigurimit pasuror të sekuestros preventive për pasurinë me nr.43/189/1 pasurie, zk.8602, vol.95, faqe 247, me sipërfaqe prej 3996,5m2, ndodhur në lagjen Uji i Ftohtë, Vlorë.

The value of the seized property, according to calculations based on market prices, reaches the figure of 1,200,000 euros," the announcement states.
