SPAK has registered a new criminal proceeding and has launched investigations into the role of former Minister of Health Ogerta Manastirliu and former General Secretary Gelardina Prodani in increasing the cost of the sterilization concession and the abusive implementation of the contract with the concession company SaniService.

The investigations have started after a criminal report for the alleged criminal responsibility of Manastirli and Prodan during the implementation of the contract for the sterilization service of surgical instruments with a 10-year term.
Representatives of SPAK and BKH, on behalf of the investigation, have seized documents from the Ministry of Health.

According to the criminal complaint, the pair Manastirliu-Prodani abused their duty and committed the crime of corruption in cooperation, changing the concession contract and increasing the cost in an abusive manner.
Specifically, on January 15, 2020, the Ministry of Health headed by Ogerta Manastirliu and represented by the General Secretary Geraldina Prodani, changed the contract with the sterilization service company SaniService, anticipating the expansion of the service and the increase of the cost for the state budget.

By amending the concession contract of 2015, Ogerta Manastirliu, through her representative, Gelardina Prodani, provides that the company SaniService can offer surgical sets beyond the ceiling defined in the contract, 63 thousand operations per year, by applying a discount of 25% of the price for any service with equipment for operations beyond the number 63 thousand.

In the amended contract, this change is argued with the effectiveness of the sterilization concession as well as the need to increase the service.

So, according to Manastirli, the concession had borne fruit and as such should be expanded. This intervention in the contract has increased the cost and the bill for the state budget, a product of Albanian taxes.

The biggest abuse consists in another decision.

Ogerta Manastiriu has allowed the embezzlement of 7 million euros in 2018, through the use of high-level sets of surgical equipment worth 140,000 Lek instead of 3,000 Lek sets for the removal of nails, changing bandages for wounds, any modest cut etc.

Ilir Beqaj left as Minister of Health on March 12, 2017, when the number of operations was about 4 thousand under the provision of surgical equipment service by the concessionary sterilization company.

Today, the number of operations has reached over 400,000.

On March 16, 2017, Erion Manohasa, then Director General of the Mandatory Health Care Insurance Fund, notified QSUT through a letter that the high-end and expensive sterilization service should be extended beyond operating rooms, covering any ambulatory material sterilized by steam or low temperature, used for wound treatment, bandage change, light cuts, etc.

So, the paperwork consists of using the sterilization service both for an operation in the room and to remove some pen or change a wound, increasing the cost. Specifically, the equipment sets would be used both in and out of operating rooms.

The sterilization contract provided for 5 types of services.

1. Sterilized instruments for interventions with high complexity, worth about 400 thousand Lek per package.
2. Sterilized instruments for interventions with medium complexity at a price of 220 thousand old lek per package.
3. Sterilized instruments for interventions with low complexity worth 140 thousand ALL.
4. Steam packs, for minimal intervention outside the operating rooms, worth about 3 thousand Lek or 3 USD.
5. Low-temperature packages for minimal intervention outside the operating room, worth about 10,000 Lek or 10 USD.

Manohasa's order stipulates that level 3 with a cost of 140,000 lek should be used instead of level 4 for minimal intervention at a cost of 3,000 old lek.

Instead of paying $3 per pack, it was $140 per pack because doctors were prohibited from using steam and low-temperature packs by Manohasa's order.

On August 15, 2018, i.e. 18 months later, the new director of the Compulsory Healthcare Insurance Fund, Eduart Ahmeti, rejected Manohasa's letter of March 2017, which increased the cost of the service.

Eduart Ahmeti orders that the equipment sets for the three degrees of complexity (high, medium and low) be used only in the operating rooms, due to the cost. There is no logic that a set worth 140,000 ALL was used, for example, to remove nails or treat a wound.

This maneuver of Manohasa, then overthrown by Eduart Ahmeti, has brought an additional cost of 7 million euros, money that came from the state budget, therefore from the pockets of Albanians.

During the consumption of this abuse, Ogerta Manastirliu was in charge of the Ministry of Health, who put her "head in the sand", at least abusing her duty.

In the criminal report, in addition to making them defendants, a property investigation is also requested for Ogerta Manastirli, Gelardina Prodani and Erion Manohasa.
