'Sterilization' case split: Beqaj will be tried separately under

The court hearing of the "Sterilization" case took place today at the Court Against Corruption and Organized Crime.

Former Minister of Health, Ilir Beqaj, in his statement before the trial panel, stated that he had requested from the Special Prosecution a decision from 2017, which states that the "Sterilization" case was dismissed by the Tirana Prosecution.

He has asked that this be taken as evidence.

"My defense has received a response from Mr. Kondili, as the prosecutor of the case, for a request we made to SPAK. I have requested from SPAK to obtain a 2017 decision from the prosecution of serious crimes. I have made this request several times. SPAK did not make it available to me, I found this decision at the Assembly, which went to the Assembly for the investigative committee. The decision has to do with a decision by the Tirana Prosecution Office to dismiss the case for the sterilization file. In my opinion, the proceeding body does not review evidence of innocence, it has a legal obligation to request both evidence for the sentence and for the innocence of a defendant. I want this decision to be taken by the court and reviewed as evidence," said Beqaj.

Prosecutor Kondili once again presented his request that Ilir Beqaj, Klodian Rrjepaj and Ilir Rrapaj be tried for "theft", abuse of office, as well as for the criminal offense of "structured criminal group".

There were objections from Beqaj's side, along with his lawyer, Ermal Yzeiraj. The latter expressed that he is unclear about SPAK's accusation against his client.

"I am unclear about the charges, as the prosecution has not specified the charge, because verbally they say theft by abuse of office and criminal group, while in writing it is abuse of office. I am unclear about what I will defend myself against ," said lawyer Ermal Yzeiraj.

Beqaj was also in support, who said " I am prepared for the criminal offense of abuse of office. As he has justified me for abuse of office and he must justify why it is theft. You have never said this accusation, you have only said the word we accept. Without a precise formulation of the accusation, I cannot answer. They have imposed different articles of the Criminal Code on us in 3 different heads. We have become like a driving school, I cannot make an effective defense without a written accusation. "

In conclusion, the former Minister of Health, Ilir Beqaj, will be tried by the Criminal Court for the criminal offenses of "theft" by abuse of office, and "structured criminal group".

Thus, Ilir Beqaj will be tried alone under normal procedure, while all other defendants will be tried in a summary trial.

The drawing of lots is expected, which will determine the new body of judges in charge of Beqaj's trial.

On the other hand, the GJKKO has rejected the request of Klodian Rrjepaj and Ilir Rrapaj for a declaration of incompetence and sending it to another court, because this matter is within the competence of SPAK.

The next court hearing for the 8 defendants, with the exception of Beqaj, will be held on June 11, at 10:00.
