The Constitutional Court has announced the postponement of the session for the review of the constitutionality of the agreement signed between Italy and Albania for the accommodation of immigrants.

The Constitutional Court has requested that the Council of Ministers present evidence for the agreement, submitting for review the friendship treaty signed between Italy and Albania in 1995.

The Constitutional Court says that the President of the Republic has not submitted written objections. As for the opinion from the European Court of Human Rights, the Constitutionalist says that she reserves her opinion at the end of the review.

Notice of the Constitutional Court:

1. Today on 18.10.2024, the Constitutional Court considered in a plenary session on the basis of the documents the request submitted by 30 deputies of the Assembly of the Republic of Albania (the petitioner), with the object: "Declaration incompatible with the Constitution of the Protocol between the Government of the Italian Republic and the Council of Ministers of the Republic of Albania, "For Strengthening Cooperation in the Field of Migration" and the prohibition of its ratification by the Assembly. Suspension of the procedures for the ratification of the Protocol between the Government of the Italian Republic and the Council of Ministers of the Republic of Albania, "On Strengthening Cooperation in the Field of Migration".

2. The court considered the written claims of the applicant, the written objections of the interested entities the Parliament of Albania (the Assembly), the Council of Ministers of the Republic of Albania (the Council of Ministers) and the People's Advocate and the evidence presented by these entities, while ascertaining the absence of written objections from the President of the Republic.

3. During the examination of the case, the Court found that the interested entity, the Council of Ministers, has denied that the Cooperation Protocol was concluded based on the Treaty of Friendship and Cooperation between the Republic of Albania and the Republic of Italy of 1995. In these circumstances, the Court based on Article 44/a of its organic law assessed that the examination of this Treaty is necessary for the full investigation of the case, so it decided to ask the Council of Ministers to present this evidence and for this reason, the next plenary session will take place on 24.01.2024, at 11.30.

4. Regarding the request of the group of deputies to receive an advisory opinion from the European Court of Human Rights, the Court decided to reserve its opinion at the end of the judicial review.
