The Constitutional Court has decided to partially accept the request of the "Diaspora for Free Albania" association regarding the vote of immigrants, where it was not realized even in the previous elections of April 25, 2021.

The "Constitutionalist" states that the constitutional right of immigrants to vote in the parliamentary elections has been violated. The decision of the Constitutional Court obliges the Assembly of Albania to fill the legal gap for the vote of immigrants within one year.

The final decision will be announced as reasoned within the legal deadlines provided by law

Notification:

The Constitutional Court of the Republic of Albania considered in a plenary session on the basis of the documents the request of the Association "Diaspora for Free Albania", with the object: "Determining the violation of the constitutional right of immigrants to vote in the elections for the Assembly of Albania on 25.04.2021 . Declaration of Order no. 219, dated 19.04.2021 "On the quarantine of persons coming to the Republic of Albania from the Republic of North Macedonia and Greece" as incompatible with the Constitution of the Republic of Albania.".

The Constitutional Court, in support of articles 131, point 1, letter "a" and 134, point 1, letter "h", of the Constitution, as well as articles 49, point 3, letter "d", 51/a, point 1, letters "b" and 72 of law no. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", amended, by majority vote,

DECIDE:

1. Partial acceptance of the request.

2. Finding the violation of the constitutional right of immigrants to vote, in the elections for the Assembly, due to the legal gap.

3. Obligation of the Assembly to fill the legal gap within one year from the entry into force of this decision.

4. Suspension of the trial related to Order no. 219, dated 19.04.2021 of the Ministry of Health.

This decision is final and enters into force on the day of its publication in the Official Gazette.

The final decision will be announced as reasoned within the legal deadlines provided by law no. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", as amended by the Regulation on the judicial procedures of the Constitutional Court.
