22 illegal constructions in the country are confiscated

The National Council of the Territory has decided to confiscate 22 constructions without permission in several cities of the country.

In the official announcement, it is announced that the decisions were taken during the meeting held today. The largest number of buildings erected without permission are in Tirana, more specifically, nine of them.

While 5 were seized in Kavaja, 4 in Vlora, 2 in Himare and 1 in Saranda. Until now, no other details have been disclosed regarding these buildings, which businessmen belong to them or under what circumstances 22 buildings were erected without obtaining any permission.

This action is a continuation of the one launched in September, by order of Prime Minister Edi Rama. In September of this year, the Council of Ministers approved the decision on the confiscation of constructions without permission, through which the building owners must either buy the construction without permission at the market price and legalize it, or donate it to the state, or else it is seized.

Full Notice:

Today, at the meeting of the National Council of the Territory, several decisions were approved for the confiscation of constructions carried out in violation of the permit for the purpose of profit. The confiscated buildings are located: 9 in Tirana, 1 in Durres, 5 in Kavaja, 4 in Vlora, 2 in Himarë and 1 in Saranda. In total, since the start of this trial after the release of the relevant VKM, the number of confiscated buildings has gone up to 22 and 1 with a promise-sale contract worth 1 euro.

On-site inspections continue, while the VKM entered into force, obliging the local units or the KKT itself for special permits, to carry out supervisory inspections of construction sites and report them every 45 days.

In this way, this illegal practice will be disabled and any responsibility will be finally clear, while citizens' investment will be protected, as well as public and private property.

The government is proceeding in parallel with the implementation until the end of the confiscation procedure and the transfer of the entire 97487.556 square meters confiscated so far, to efficient use for public interest. All these procedures will not only be precise in legal terms, but also transparent to the public. We will inform the public of any decision-making related to the use of these spaces.

The decisions taken are different because the law defines different degrees of measures, depending on the typologies of violations and cases. The law provides that the entity can be fined and partially confiscated, only when it has built less than 10% additional volume from the construction permit. When these volumes are more than 10%, in addition to the fine, the confiscation measure is complete for the entire building. In the case of demolitions, unlike confiscation, again the law is very clear on when the building is demolished and when it is not.

The appeal to all builders is to strictly implement the law, while for citizens we are working to ensure that all permit enforcement checks are also online, where every buyer can follow the progress of his investment through his mobile phone and not fall victim to abusers as he has usually happened in the past.

Meanwhile, Decision No. 610, dated 22.9.2022 "On determining the detailed rules for the appointment of the supervisor, his duties and responsibilities, the conditions and general elements of professional liability insurance, as well as the rules, procedures and manner of keeping of documentation during the development of works" instructs the supervisor to notify online within 5 days to the relevant authorities, in cases where he notices that the works carried out are in violation or exceed the construction permit, as well as online again every 45 days he will file the performance report of works. Part of the system at the same time are the relevant authorities that issued the construction permit. IKMT as well as the local inspectorates of the protection of the Territory
