Criminal Amnesty

The government approved the Criminal Amnesty today.

The news was confirmed by the Minister of Justice, Besfort Lamallari , through a statement after the meeting of the Council of Ministers.

The Minister announced that 447 people will receive immediate release from prison and 853 others will receive reduced sentences.

Among them are women, minors and foreign citizens. The real number of beneficiaries of the suspension of criminal prosecution is much higher.

" At today's Government meeting, we approved the Criminal Amnesty, the initiative we presented about a month ago, and as of today, this decision is being submitted to the Parliament. From the latest data coordinated with the General Directorate of Prisons, the Probation Service and the General Prosecutor's Office, it results that a full 447 people benefit from immediate release and 853 others from reduced sentences, while the Probation Service amnesties 5,077 convicts with alternative measures. Furthermore, starting in 2024, criminal prosecution for a full 14,000 proceedings for minor offenses is discontinued. In addition to a clear humane act and a second opportunity for rehabilitation and reintegration, this is a concrete step that reduces the pressure of prison population and focuses justice where the social danger is real. This is not about tolerance towards crime, but about a measured approach that aims at reintegration and more efficient use of criminal justice as we are working to "reduce the unnecessary use of pre-trial detention, in line with the legitimate concerns raised by the Council of Europe as well as European standards ," said Minister Lamallari.

The Minister of Justice further says in his statement that he expects Parliament to review the draft law without delay so that the amnesty can begin its effects.

"Our ambitious goal is to have a system that knows how to punish severely when necessary, but also to give a chance to return to society. Justice is not only punishment, but also a second chance guided by humanity and rehabilitation. I thank all the institutions that contributed to this process and I expect the Parliament to review the draft law as soon as possible, so that the positive effects of the amnesty can be felt by thousands of Albanian families", declares the Minister of Justice, Besfort Lamallari. Subjects of the Prosecution Office and the Special Court for Corruption and Organized Crime do not benefit from this amnesty.

The amnesty bill will be submitted to the Assembly, where it will begin its review in parliamentary committees and then move on to the plenary session for approval.
