Former prosecutor: How can Erion Veliaj be in prison, not suspended and still on

After the Supreme Court decided to keep Erion Veliaj in prison, rejecting the appeal of the defense of the mayor of Tirana, former prosecutor Eugen Beci reacted.

He described as paradoxical the fact that a senior official can be simultaneously on duty and under arrest.

"Mr. Veliaj filed a request with the Constitutional Court and the Constitutional Court found Mr. Veliaj's claims partially correct, regarding two main elements, which have to do with the presumption of innocence, linking it to the fact that the reasoning for the rejection of this claim by the high court was not sufficient and the second point that had to do with the reasoning of the decision regarding the proportionality of the determination of a security measure for a mayor who is in office and is currently under arrest in prison.

"These are strange, paradoxical elements, but they are good for the public, they are good for the security measures of the people, because certain conditions and criteria are set, which should raise the bar to say that the security measure of arrest in prison is an exceptional measure, not an ordinary measure, but they are paradoxical due to the simple fact that the mayor of the capital is a defendant, is in prison, and is also in office," he said on A2 CNN.

According to him, only in Albania can elements of this type occur.

"There are elements of this type that it seems that the entire legal corpus for the fight against corruption has been unclear and unpredictable in terms of moments of this type. It is not possible for a senior official to be both a defendant, not suspended, and still in office," he said.
