The roundtable discussion "Assessment of the Institutional Architecture in Function of the Performance and Integrity of the Special Prosecution: Guarantees for Independence and Accountability Mechanisms Organized by the Center for the Study of Democracy and Governance" is being held.
Also present at the meeting is the EU Ambassador, Silvio Gonzato, who praised SPAK as a fundamental institution.
The Ambassador said that the justice reform has delivered what was expected of Albania on its path towards the EU, while adding that there is still much work to be done in its full implementation.
"Judicial decisions have a direct impact on the lives of citizens. Independence without accountability increases the risk of abuse of power. In our enlargement reports, as we have said, and in the rule of law report, we have said that the architecture of justice reform provides an appropriate and fair balance between accountability and independence."
The justice reform has delivered what was expected of Albania and has made a major contribution to the remarkable progress towards the EU. There is still a lot of work to be done in implementing this reform, and we encourage the relevant institutions, especially the independent justice institutions. What we see today is part of the accession process, monitoring by civil society. All these are fundamental things in any system”, said Gonzato.
While saying that he wants to see the 'glass half full and not half empty', Gonzato stressed the importance of maintaining these positive steps achieved. He also stopped at the KLP, as he praised it for the progress it has made in evaluating prosecutors.
"I want to see the glass as half full and not half empty because we need to maintain these positive steps that have already been made. First, I emphasize the achievements of the KLP that I had the pleasure of meeting in its full format recently. Our assessment shows that the KLP has made significant progress compared to previous years in evaluating prosecutors. Even prosecutors' assessments are based on their performance. These indicators should be the subject of structured and methodological reviews.
For example, criteria such as case efficiency, managerial skills and work ethics may require adjustment and we trust that the KLP will make these reviews. But the accountability part does not remain exclusively on the shoulders of the KLP, which is why we have also encouraged the ILD and the School of Magistrates. We welcome that such meetings have become more frequent, marking an important step forward in terms of accountability,” added Gonzato.
Furthermore, he also praised the transparent process of selecting the head of SPAK, adding that such a practice should be followed with other appointments. Gonzato also recalled several recommendations made in previous EU reports that he said should be addressed quickly.
