The Constitutional Court has heard the DP's appeal for the establishment of an Investigative Commission on the McGonigal case, which was rejected by the socialist majority.

In their request, the deputies request that the Constitutional Court determine the obligation of the Assembly to establish an investigative commission to verify the legality of the actions of Albanian officials in relation to former FBI special agent Charles McGonigal.

In parallel, the deputies have also requested the establishment of a second investigative commission, with the aim of controlling the legality of the activities of central and local government bodies, as well as verifying the use of state administration resources for electoral purposes in the elections of May 11, 2025.

"Resolving the dispute over competence between no less than a quarter of the deputies and the Assembly of the Republic of Albania, determining the obligation of the Assembly to establish the Assembly Investigative Committee:

(i) “On verifying the legality of the actions of Albanian officials in relation to former FBI Special Agent Charles McGonigal”;

(ii) "On the control of the legality of the activities of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025".

2. Declaring decision no. 77/2025 of the Assembly of Albania “On the non-approval of the draft decision “On the establishment of the Investigative Commission to verify the legality of the actions of Albanian officials in relation to former FBI special agent Charles McGonigal”, as incompatible with the Constitution of the Republic of Albania.

3. Declaring decision no. 78/2025 of the Assembly of Albania "On the non-approval of the draft decision "On the establishment of the Investigative Commission to control the legality of the activity of central and local government bodies, as well as to verify the use of state administration resources for electoral purposes in the elections of May 11, 2025", as incompatible with the Constitution of the Republic of Albania", states the notice of the Court of Appeal.
