The representative of the Assembly presented the arguments of this institution regarding the debate on the suspension from office of Belinda Balluku by decision of the GJKKO.
In her speech, she stated that a deputy or minister cannot be prevented from exercising his or her duties or arrested without the consent of the Assembly.
According to her, the suspension does not only affect the individual, but also the Council of Ministers.
"The MP enjoys immunity, cannot be prevented from exercising his/her duties, cannot be detained or arrested without the consent of the Assembly. Criminal prosecution is carried out with the approval of the Assembly ," she said.
According to the representative of the Assembly, this decision of the Constitutional Court violates the principle of separation of powers and constitutional competences.
"The suspension of a minister creates a situation where the judicial power interferes with the functioning of the highest constitutional executive bodies," she further said.
