A preliminary hearing for Sterilization is being held at the Special Anti-Corruption Court, after the court aggravated the position of former Minister of Health Ilir Beqaj, former Deputy Minister Klodian Rrjepaj, and businessman Ilir Rrapaj.
Beqaj has requested the exclusion of Judge Flojera Davidhi from the review of the "Sterilization" case, arguing that she has refused to give a reasoned decision on the aggravation of the charges against him.
It is reported that Beqaj's request has in fact been rejected by the court. Beqaj has stated that the accusation against him is biased and that he will not fall prey to pressure to request a summary trial.
"My rights have been violated, my accusations were made by the DP, you have deliberately damaged the process, there is no written accusation for what I am accused of, your influence is political, your decisions are applauded by Sali Berisha, you and the prosecution did not want to reveal the truth, I have no way to defend myself, but only to denounce. The accusation is tendentious, I do not fall prey to the pressure of the summary trial to not open the evidence 1 by 1", declared the former Minister of Health.
The former minister's speech at today's session:
You irreparably destroyed the process, the investigations and the accusation and through your illegal silence, you have made it impossible for us to effectively defend ourselves for facts that are not in the accusation and that you do not explain where you saw and with what evidence you support them as facts.
This entire criminal process, as I have repeatedly stated in this courtroom, began as a political process, continued as a political investigation, and you, honorable judge, with the decision of December 23, 2024, laid an important stone in the foundations of the politicization of this criminal case. Since I, Ilir Beqaj, could not go unindicted in this criminal case, and since you found that neither the violation of equality in the tender, nor the abuse of office, nor passive corruption were present, the charge of theft and of a structured criminal group was invented. I assure you that I will dismantle these two charges as well. But I want to state that you have also become part of the inquisition against me.
Secondly, I assure you that even if you accuse or sentence me to death or life imprisonment, you will not be able to undo my 33-year contribution to the public life of the country, nor tarnish my name or the surname of my family.
But you will not be able to tarnish or criminalize either Edi Rama's first government or the Socialist Party.
After 5 years of investigation, the court has accepted that the object of the contract was a public need of Albanian health.
The Special Prosecution Office found no elements of the criminal offense of violation of equality in the tender.
The Special Prosecution Office did not find elements of the criminal offense of passive corruption, neither of high-ranking officials nor of public officials.
Your decision was not unexpected for me, although many may have been surprised. It was in the wake of the surprises that there were also 2 decisions of the preliminary investigation judge, in the decisions of June and October 2023.
The fact that the prosecutors declared that they did not find any criminal offense of violating equality in the tender and the fact that you, the judges, also accepted this statement of theirs confirms the untruthfulness of the statements in the decision in question by Judge Bani.
I declare that he has consciously decided not to take them into consideration, not to mention that he does not know them, because if we were to prove that the judges of the Special Court do not know these things, this would be the greatest failure of the justice reform. We truly need uncorrupted and incorruptible judges, but first of all we need capable judges.
What value is there in being uncorrupted when the judge is influenced by public, media, and political pressure anyway?! And what value is there when the judge is not influenced by anyone, but lacks the ability or desire to understand and accept the truth and the law?
Madam Judge, with your decision you decide to join MPs Albana Vokshi and Petrit Vasili. After years and years, when the words "thief" and "theft" have been used routinely by politicians for mutual attacks, it seems you also decide to try them out by becoming part of the political debate.
It was proven that during the investigations, the prosecution did not make any effort to find evidence in my favor, even though this is required by Article 8/a, point 2 of the Criminal Procedure Code. The number of surgical interventions in 2013 is mentioned several times in the investigation file. The feasibility study mentions that there were about 50,000 surgical interventions. Meanwhile, according to the prosecution, there were 63,000. In 5 years, the prosecution did not bother to investigate for itself how much this number actually was. It never officially asked the Ministry of Health, even though the investigation file contains the official responses of the QSUT and the University Trauma Hospital.
The prosecution has not left a corner of the internet without rummaging for evidence against me. Regarding the number of surgical interventions in 2013, it did not even bother to read the annual reports of the QSUT on the internet, or the official website of INSTAT. If it had done so, it would have discovered that the number 63,000 is incorrect. The figures submitted by the hospital managers, with signatures and seals, are significantly different from those taken into account by the prosecution when it calculated the total of 63,000 surgical interventions in 2013. You did not even ask the prosecution to prove the truth of the figure 63,000.
My defense has received an official response from the Ministry of Health. The number is significantly different from 63,000. We will make the response document public at the trial of the merits. There we will show before the public how incomplete and malicious the investigations of the prosecution were. We will show how incomplete the trial was in this preliminary hearing. There we will show how biased the head of SPAK, Dumani, was, with the specific instructions he gave to the prosecutors of the case for this purpose in April or May 2023. We will prove how malicious the decision of Judge Bani of June 23, 2023 was towards my person. We will prove how non-existent Artur Metani, the head of ILD, is, as we will also publicly tell foreign diplomats about the truth of the concession of integrated surgical instrument management services in public hospitals in Albania.
Meanwhile, you invited the prosecution to conduct investigations that seem absurd. First, in the interim decision (no. 4), you did not even cite the relevant article 332/ç of the Criminal Procedure Code, which gives you the right to order the completion of preliminary investigations. Second, on December 23, 2024, you requested that within 2 months, i.e. until February 23, 2025, prosecutors investigate for abuse of office, employees of the Ministry of Finance and Gazmend Vehbi. But it is known worldwide that after January 12, 2025, the criminal offense of abuse of office for these persons is statute-barred.
You requested additional investigations for 4 members of the KPP for "abuse of office". The criminal offense that members of the KPP can commit is the violation of equality in tender. The prosecution stated that there is no violation of equality in tender in this criminal case. You admitted this. Then, why are you making absurd requests.
Regarding the request to investigate Artur Lama and Alfred Çareri, you indicated that your decision was made under political pressure, and that you, willingly or unwillingly, have become a tool of the inquisition mechanism against Ilir Beqaj. Those two people should be investigated because the DP failed to include their names in the list of witnesses of the investigative commission.
Regarding the two concessions in Health, former Minister of Health Ilir Beqaj has been under investigation by SPAK for more than a year.
Beqaj is suspected of abuse of office in connection with 2 signed tenders, for sterilization and check-ups. These 2 cases are being investigated by 3 prosecutors.
The sterilization concession is being investigated by prosecutors Edvin Kondilli and Ened Nakuçi, while the 'check-up' concession is being investigated by prosecutor Elida Kaçkini.
On March 18, SPAK announced the closure of the investigations, while informing the charges against 8 other people involved in the 2 concessions file.
But currently, Beqaj has been in prison since July 4, accused of abusing EU funds while he held the position of director of the State Agency for Strategic Programming and Aid Coordination (SASPAC).
A position he held after leaving his post as Minister of Health.
