The history of accusations of a criminal organization 'Hakmarja per Drejësi' seems to have been finally sealed by a decision of the Supreme Court yesterday.
With a decision taken in the consultation room, the Supreme Court has decided not to accept the recourse of the prosecution for the defendants accused as part of the organization, leaving in effect the decision of the Court of Appeal for Serious Crimes, which declared them innocent.
The decision was reviewed this Tuesday, where the trial panel decided not to accept the appeal made by the prosecution of serious crimes, which had requested the return of the case for trial at first instance.
The decision of the Court of Appeal was announced on February 13, 2017, when the defendants were acquitted of all the members of this gang convicted by all other levels of trial.
The court acquitted Orik Shyti, Leart Shyti, Altin Arapi, Dritan Hata, Gent Caka, Nikoli e Pasho Novruzaj, Gëzim Gjoni, Roland Shyti and Kreshnik Spahiu.
The process against the "Revenge for Justice" gang has lasted nearly three decades and due to numerous requests for trials and retrials, a large number of judges have been involved in the process.
The organization "Revenge for Justice" was publicly announced on October 13, 1996, but the Prosecutor's Office of that time claimed that it was created in 1992 in the city of Durrës. The trial against the organization started in 1998, but it was returned for trial at the request of the main accused Orik Shyti. The Shyti brothers are the sons of Aredin Shyti, one of the important figures of the Ministry of Interior in the communist dictatorship and in the government of the former prime minister Fatos Nano in 1991.
The convicts of "Revenge for Justice" have rejected the claims and all the charges, including murder, bank robbery and even kidnapping. The most serious crimes for which the members of this gang are accused are the murder of the former Director of Prisons, Bujar Kaloshi, the murder of 4 civilians by placing a bomb in the former supermarket of the "VEFA" company, as well as the execution in the center of Tirana of the driver of the former Prosecutor General, Theodhori Sollaku.
Appeal decision
In February 2016, the Court of Appeal for Serious Crimes overturned all these charges, giving a final verdict of acquittal and acquittal of all charges for all the defendants. According to the Court, the main evidence presented in the process was either absolutely unusable, or was taken in the wrong legal and procedural form, which made them invalid. The prosecution was against the decision-making in the Court of Appeal and requested in that session that the file be returned to the Court of First Instance for a full judicial review.
"The Court of Appeal for Serious Crimes decided to change the decision of the Court of First Instance for Serious Crimes dated 1.07.2008", read the abbreviated decision, which declared all the defendants in the case innocent. In the same decision, the court ordered the cancellation of the security measures imposed on the defendants in their absence, as well as the release of the two defendants who are in the cell, Gentian Çaka and Dritan Hate. The decision of the Court of Appeal for Serious Crimes was given on 13 February 2017 and immediately the KLD announced the launch of an investigation into this case.
