The Council of Ministers has drafted a new and comprehensive draft law that establishes strict rules for the control, supervision and inspection of every entity licensed to cultivate and process cannabis for medical and industrial purposes in Albania.

The draft law, which implements Law No. 61/2023, aims to guarantee public safety and public health, by establishing a hermetic traceability system for every movement of this plant, from the import of the seed to the export of the final product.

Combined surveillance, agents on the ground and satellites in space

To avoid any possible diversion of the product to the black market, the government has authorized the National Cannabis Control Agency to use state-of-the-art technology. Physical inspections alone will not be enough, but companies will be under the "magnifying glass" of the authorities 24 hours a day.

According to Article 28 of the decision, the government specifies the high-tech tools that will be used for monitoring.

"Remote surveillance, control and inspection are carried out through visual monitoring systems (CCTV), unmanned aerial vehicles, satellite platforms, sensors and digital platforms," the decision states.

This continuous surveillance will be implemented in every environment where activity takes place, giving authorities real-time access to companies' alarm and telemetry systems.

No movement outside the system

One of the main pillars of this decision is the National Traceability Registry and System. Every plant, plant, or by-product will have a clear and marked identity. The document makes it clear that no action will be allowed without being digitally recorded.

The decision states categorically that "every movement, transfer, opening, re-closing, receipt, submission for analysis, change of storage location or any other action on the material is recorded continuously in the chain of custody and traceability."

The transport of these products will only be carried out in closed, secure vehicles where the material is not visible from the outside. Any deviation from the itinerary or unjustified interruption will be immediately dealt with by the authorities, in close cooperation with the State Police.

Quality standards and laboratory tests

To ensure that medical and industrial products meet the required standards, the Agency has the right to take samples at any stage of cultivation. For industrial cannabis, the maximum permitted threshold of the psychoactive substance (THC) remains fixed.

"For the total THC level for cannabis for industrial purposes, the lot is considered non-compliant when the measured value exceeds the maximum permitted limit of 0.8%," states Article 20 of the decision.

If the analysis shows deviations, the product is immediately placed in quarantine. After exhausting the rights to retest by the subject, if the result remains non-conforming, the decision clearly specifies the fate of the product: “The non-conforming lot is not allowed to be released into circulation and the destruction procedure continues.”

Confiscation and destruction

For entities that violate the terms of the license or attempt to operate outside the legal framework, the measures are severe. The decision authorizes the Agency's employees to temporarily seize the product whenever they observe suspicious circumstances, to prevent the disappearance or alienation of evidence.

When violations are confirmed, such as the cultivation of unmarked material, the case is passed on to the minister responsible for confiscation. The plant or by-products are then irreversibly destroyed by special structures, in the presence of the State Police, so that “the material becomes unusable and irretrievable for any further use.”
