After seven plenary meetings, the KLP has not yet managed to begin reviewing the requests of two candidates for the exclusion of two members from the procedure for selecting the Prosecutor General, a situation that has raised concerns for the Prosecutors' Association, which is asking the council to overcome the impasse and guarantee the continuation of the procedure.

The process for electing the Prosecutor General continues to remain stalled after the High Prosecutorial Council, KLP, failed, during seven plenary meetings held since August 28, to review the request of two candidates for the exclusion of two members of this council from the selection procedure.

The procedure for electing the Prosecutor General was hit by a stalemate after candidate Ylli Pjetërnikaj requested the exclusion of member Vatë Staka from the applicant evaluation process, claiming that he was in a conflict of interest. Pjetërnikaj's request was followed by a series of requests by KLP members to exclude each other, making it impossible to establish the necessary quorum for decision-making in several meetings.

The review of requests for exclusion among members was concluded at the plenary meeting on Friday, October 2, when, by a majority vote, the request of member Vatë Staka to exclude colleague Zeqir Hoda from the review of Pjetërnika's request, as well as from the procedure for selecting the Prosecutor General, was accepted.

In addition to Pjetërnika requesting the exclusion of Staka from the selection procedure, candidate Arta Marku is also requesting the same for member Sokol Stojani. The council announced that the next meeting when these requests are expected to be reviewed will take place on October 7.

The situation created by the High Prosecutorial Council in the procedure for selecting the Prosecutor General has raised concerns among the prosecutorial corps.

"The Prosecutors' Association assesses that the situation created is worrying and requires the adoption of appropriate measures, in accordance with the constitutional and legal framework, without further delay. Requests for exclusion must be considered seriously, because impartiality is an essential condition for the credibility of the process. But this procedural guarantee must not turn into a cycle of mutual requests that paralyzes the decision-making of the KLP," the Prosecutors' Association noted, based on questions that BIRN addressed to them regarding the situation created in the KLP.

According to the association, exceeding deadlines and blocking the procedure undermine the regularity and credibility of the selection process of the Prosecutor General. It is also underlined that the defined mandate of this function requires the KLP to act in a timely and responsible manner, resolving requests for exclusion through reasoned and transparent decisions.

"Without prejudice to the merits of the claims, the prolongation of this impasse damages the authority of the KLP, the normal functioning of the prosecutorial system, as well as the public's trust in the justice system as a whole. The KLP has the responsibility to ensure a process that is both impartial and functional, which cannot remain hostage to internal disputes. Prosecutors also expect the Council to overcome the impasse and guarantee the continuation of the procedure, in full respect of the law," concludes the Association of Prosecutors.

As a result of successive requests among members for their exclusion, the deadlines for the candidate verification procedure were exceeded. At the meeting on September 18, in excess of this deadline, the council agreed that the administration should send the asset declarations of the five candidates to the High Inspectorate for Declaration and Control of Assets and Conflict of Interest, HIDAKKI, for verification.

The 7-year mandate of the current Prosecutor General, Olsian Çela, ends on December 5. According to constitutional provisions, the Prosecutor General is elected by three-fifths of the members of the Assembly, from among three candidates proposed by the High Prosecutorial Council, for a 7-year mandate and without the right to reappointment. The Constitution also stipulates that one of the cases when the mandate of the Prosecutor General ends is when his 7-year mandate ends, which makes it impossible for the current Chief Prosecutor to continue in office beyond his mandate, if his successor has not yet been selected.

The five candidates running for a seven-year term as Prosecutor General are: SPAK prosecutor Adnan Xholi; former Acting Prosecutor General Arta Marku, currently a prosecutor at the Tirana Appeals Prosecution Office; Eurojust prosecutor Fatjona Memçaj; Tirana prosecutor Rovena Zoto; and prosecutor Ylli Pjetërnikaj, currently an internal lecturer at the School of Magistrates.
