The vice-chairman of the Investigative commission for the leak of TIMS system data has reacted after leaving the meeting that was being held the day before.
In a long post on social networks, Toni Gogu explains why they boycotted the meeting, while according to him, leaving was the only way to stop the violation of the law.
Toni Gogu's full post
Yesterday we left with pain from the Commission of Inquiry into the treatment of TIMS data. In yesterday's meeting, we were forced as members of an Investigative Commission, to witness how the Law was systematically violated with ignorance as a worthless thing.
The law that we had to respect on the Organization and Functioning of Investigative Commissions charges us, the legislators, to: (cit.) investigate through procedural actions to clarify a particular issue (in our case, the activity of the institutions charged with the protection of the TIMS system ), but without taking defendants and without filing criminal charges.
The law does not authorize us to accuse, so every time we accuse instead of investigating, the law is broken. The law does not authorize us to declare guilty, so every time we do so without asking any questions, the law is violated.
We, the legislators who are members of the Investigative Commission, in implementation of the law on investigative commissions, are assisted by legal experts. From those legal experts of the Commission, who were approved by qualified majority. The law charges legal experts with gathering information and drafting the Investigation Plan. We VOTE on the Voting Plan, and then implement it meticulously in calling and questioning witnesses and heads of institutions.
How incompetent or in bad faith do you have to be not to understand this?!
We, the members of the investigative committee, vote!
We vote every request for information! We vote on the investigation plan!
We vote for any changes or additions to this panel!
VOTING is the basic rule in the decision-making of a Commission (and not only).
There is no other way to make a decision!
Therefore, when colleagues of the Commission are deprived of the right to VOTE, because they pretend not to hear them, or pretend not to see them, not only violates the law, but also deprives the Commission of the opportunity to make Decisions.
How incompetent or malicious do you have to be not to understand this?!
To see the President of an Investigative Commission, who openly ignores not only the law of the Investigative Commissions, but also the laws of simple human logic, not subjecting the decision-making to VOTE, exceeds the pain for the violated Law.
To see someone from the legislative chair REFUSES to subject DECISION-MAKING to a VOTE and believes that demagoguery can replace the most basic procedure from which all decision-making stems, makes you feel sorry even for demagoguery consumed in vain.
The Commission is obliged by the Law to vote and approve with a vote EACH PROCEDURAL REQUEST, prepared by the experts that it has proposed.
In a situation like that of the unclear direction of the Investigative Commission on TIMS, you not only witness a legal violation, but also a bad faith and malicious behavior.
I have to explain that the procedural requests for information that are sent to the heads of law and order institutions in our republic, need to be supported by the decision-making of the members of the Commission. Voting according to the Law is necessary for decision-making, because the decisions of the Parliamentary Commissions are not like the votes of 5 thousand delegates, who voted sitting in 3 thousand chairs, and from which votes "decisions were made" announced and clarified months before the vote .
Each Procedural Request for information deserves the attention and VOTE of fellow MPs. And when he denies this right to all his colleagues, left and right, not only is the law violated, but also the intelligence of the voters who are waiting to see the results of the parliamentary investigation is violated.
For a bit of political-media show, you can even sew a bad joke, simply because it resembles a baseball bat with which you can take revenge on your political opponents. With a joke in your mouth, you can also violate the Code of Conduct of the Deputy, but you cannot undo the parliamentary procedure. It cannot replace VOTING.
There is no joke that will save you from legal proceedings.
The commission of inquiry is the only instrument that can lead us to the objective truth. Paralyzing the Investigative Commission means at least arrogantly kicking the expectations of those you believe will vote for you.
The open violation of the law, the Rules of the Assembly and the Code of Ethics, moreover, with an arrogance that cannot stem from the vote, apparently inspired by the lawsuit, made it impossible for us to continue the meeting.
That's why we left, from that ugly scene, where the law is violated and the investigative commission is paralyzed by conscience. We hope that the Speaker and the opposition colleagues who have asked to investigate, return to the questions and put aside the statements.
At least until the day the Commission may decide to call them as witnesses to as many things as they have stated and claim to know. That day they can DECLARE far and wide!
Until that day it is good to ask and listen, that is to investigate.
Yesterday we left, after regretfully finding out how the law was violated as if it were the tail of a cigarette, which you lit just to get over the next boredom or boredom. Violated with feet, hands and words.
We left because leaving was the only way to stop breaking the law.
