At a time when Sali Berisha refuses to implement the obligation to appear for the Partizani case, the officers of the Special Court will knock on his door again today.
Berisha has refused to acknowledge the security measures and to appear in court, but this could make his position worse.
GJKKO officers will try to notify Berisha after several refusals on his part. This is because the former prime minister must appear before the SPAK officer on November 20. In the event that he refuses on this date as well, SPAK has the right to address the Assembly for authorization to aggravate his position, requesting a more severe measure such as house arrest.
Since October 21, Sali Berisha has avoided contacts with judicial police officers in order to obtain from them the knowledge about the appointment of the security measure. On October 26, GJKKO accepted the requests of two SPAK prosecutors, Arben Kraja and Enkelejda Millonai, and assessed the measure against Sali Berisha as legal, in absentia, as he was represented by a lawyer mainly after his lawyers with a special power of attorney left the session.
According to the measure set by GJKKO, Berisha must appear before the judicial police officer in SPAK, Adelajda Metaj, on the first and third Monday of every month. On the first Monday of the month, November 6, the former prime minister did not appear. Meanwhile, GJKKO has rejected all the requests of Berisha's lawyers for the cancellation of the measure on November 8, as well as for the dismissal of Irena Gjoka, a request made earlier. The next step of his defenders is to appeal to the Special Appeal, arguing that the Constitution has been violated, a hearing which has not yet been scheduled.
However, GJKKO, in the disclosed decision, has specified that the former prime minister is aware of the measure assigned to him and has verbally accepted it in a press conference, as well as explained why the authorization was not received from the Assembly.
