Xhaçka's mandate in the Constitutional Court: The two lawsuits of
Olta Xhačka

The next year will start with an important issue for politics, for which the opposition and the government have clashed quite a bit.

The Constitutional Court has decided to consider in a plenary session the demands of the opposition to remove the mandate of the deputy, the Minister of Foreign Affairs, Mrs. Olta Xhaçka.

The Constitutional Court has decided that the sessions for the Xhaçka case will be opened on January 18, 2023, where two lawsuits will be dealt with on the same day, on both sides the Parliament and MP Xhaçka are the defendants. The opposition has argued in the request to the Constitutional Court that the mandate of the deputy of the Socialist Party, Olta Xhaçka, is invalid because her husband has benefited from public property by being declared a strategic investor by the Committee headed by Prime Minister Rama.

The company that will build a luxury resort on the south coast, has received from the government a beach in Dhërmi for use for 30 years. Referring to the law on the conflict of interest, the democratic deputies bring as an argument that the benefits from the public property of the husband of Minister Rama are the same as if they were registered in the name of the minister herself. Therefore, according to them, the Constitutional Court should decide on the removal of the mandate of MP Olta Xhaçka.

The Minister herself dismissed these accusations earlier and stated that there is nothing illegal in the government's decisions.

The Socialist Party has twice rejected the demands of the opposition for the establishment of an investigative commission for strategic investments, which would also include the investigation of the benefit of public wealth by the husband and other family members of Mrs. Xhaçka. In the case of the announcement of the husband of Minister Olta Xhaçka as a strategic investor, the DP parliamentary group, represented by Gazment Bardhi, has reported Prime Minister Edi Rama, in his capacity as Chairman of the Committee for Strategic Investments, to SPAK for abuse of office.

But although 6 months have passed since this denunciation, the Special Anticorruption Prosecutor's Office has not yet decided what it will do with the next political issue. /TCH
