Today, the Administrative Court examines the request of Alfred Beler for the suspension of the implementation of the President's decree for setting the date of the elections for the Himar Municipality. Beler's request will be examined by judge Etleva Gjamo, while third parties in the trial are the CEC and the State Attorney's Office.
"Taking the measure of securing the lawsuit. Suspension of the implementation of Decree no. 244, dated 05.07.2024 of the President of the Republic until the final decision is taken", it is stated in the object of the lawsuit filed in the Administrative.
Beleri's representative, lawyer Klodiana Gjyzari, has given the arguments why she opposes the decree.
"The President's decree is opposed by both Alfred Beleri and the Union Party for Human Rights. The decree directly harms the interests of the plaintiffs. The Presidency and the State Bar have the same violations. They claim that we are not legitimized in the process. We estimate that Beler has a valid mandate, a mandate that is valid until August 5, when he has the right to appeal. Until this right is exercised, his mandate is legal, as the decision of the CEC is not enforceable. We have asked for the annulment of the decree", said Gjyzari.
On July 5, President Begaj decreed August 4 as the date for new elections in Himara, immediately after the CEC decided to remove Blair's mandate as mayor of Himara.
Beleri was arrested on May 12, 2023, 2 days before the elections in Himare, and is currently serving a prison sentence for active corruption in the elections.
