The trial of Klodian Allajbeu, owner of the American Hospital, begins at the Basic Court in Pristina. The first court session in Kosovo was held yesterday, with Ekrem Lluka, Korab Lluka, Igli Larashi and Edlira Malaj also among the defendants, accused of the criminal offenses of "forgery of documents" and "money laundering".
Ekrem Lluka, owner of the "Kosovo Cardiac Center" together with Korab Lluka, Klodian Allajbeu as shareholder and legal representative of "American Hospital Kosova", Igli Larashin, executive director at that Hospital, as well as the owner of "Medbrand KS", Edlira Malaj, are accused of having "laundered money" through a scheme of forging documents and presenting false documents to the Kosovo Tax Administration.
The actions according to the investigative file were committed by the five accused when they realized that they were being investigated by the TAK and the Special Prosecution Office.
After the defendants' statements, Ekrem Lluka's defense attorney, lawyer Dastid Pallaska, requested a second hearing to challenge the evidence and request the dismissal of the indictment.
For this reason, the presiding judge, Judge Vesel Ismaili, said that with the new legal amendments to the Criminal Procedure Code, it is not foreseen to hold this hearing.
Previously, the accused Edlira Malaj said that she is not clear about the indictment and the criminal offenses she is being accused of. Special prosecutor Dren Paca provided clarification on this.
"In this specific case, you used forged documents - a contract for the sale of equipment where "Mebrand KS" was not registered at all, and as a result, you were unable to sign the contract because you were not a registered entity, and as a result, money was exchanged from this criminal activity," said the prosecutor.
Prosecutor Paca further explained to Malaj that with the money he received and transferred to Albania and Austria, he committed the criminal offense of "money laundering".
"I honestly don't understand," said Malaj.
But, after consulting with her defense attorney, attorney Shpend Lushaku, the accused Malaj said that she understands what she is being accused of, but that she feels innocent.
After the guilty plea, Judge Ismaili said that they have the right to file a request to challenge the evidence and dismiss the indictment within 30 days.
During his speech, Klodian Allajbeu requested that the trial proceed as quickly as possible, as according to him, he has been caused great harm.
Allajbeu claimed to the black platoons that he is in a problematic situation with banks and law offices.
"I plead not guilty and I have a request to move forward with the trial faster because I have been exposed to very large damages. I have about 4 thousand employees, of which 800 are in Kosovo. We are in an indictment that was filed based on rumors. I have problems with banks and legal offices abroad and I am in a problematic situation," Allajbeu said during the hearing.
The initial indictment of the Special Prosecution of the Republic of Kosovo (SPRK), which was provided by "Oath for Justice", details were given of how these five people had presented invoices and documents with entities that were not registered, in order to legitimize bank transactions and benefit from over 3 million euros.
Edlira Malaj is accused of forging documents after, as the owner of "Medbrand KS", she used forged documents and sent them to the Kosovo Tax Administration.
According to the Prosecution, Malaj had used the forged document as the purchase and sale contract between "Medbrand KS" and "American Hospital Kosova" signed on 23.10.2014, even though "Medbrand KS" had not been a registered entity at the time when the agreement was allegedly reached.
Klodian Allajbeu, shareholder of “American Hospital Kosova” and the director of this hospital, Igli Larashi, are accused of forgery of documents after they used forged documents for the sale and purchase in the amount of 4,703,999,98 (4.7 million euros) dated 23.10.2014 between the seller “Medbrand Ks” and the buyer “American Hospital Kosova” and they had presented the same documents to the Tax Administration of Kosovo. At the time when the sale and purchase agreement was signed, according to the indictment, “Medbrand KS” was not a registered entity.
The next count of the indictment charges Edlira Malaj, Igli Larashi and Korab Lluka, who was a representative of the "Kosovo Cardiac Center", with having signed forged documents with false content. They are accused of having signed in March 2021 the "Contract for the Assignment of Accounts Receivable" dated 23.12.2020 and used it by submitting it to the TAK, with the aim of misleading the public that they had allegedly signed before the TAK had initiated investigative procedures against them.
According to the indictment, Malaj, Larashi and Lluka had committed this act with the aim of legitimizing the failure to declare the payment of 1,572,842,000 (1.5 million) euros by the "American Hospital Kosova" and the "Kosovo Cardiac Center".
In addition, the next count of the indictment charges Klodian Allajbeu, Edlira Malaj and Korab Lluka with signing a forged and false document as "Annex to the contract for the assignment of accounts receivable" dated 22.03.2021 with the aim of legitimizing the non-declaration of the invoice between "American Hospital Kosova" and "Kosovo Cardiac Center" in the amount of 1,572,842,000 (1.5 million) euros.
The next count of the indictment charges Edlira Malaj and Ekrem Lluka as the owner of the "Kosovo Cardiac Center" with having jointly signed a forged and false document and having presented the same to the ATK with the aim of misleading the ATK about the alleged sale and purchase of equipment from the "Kosovo Cardiac Center" to "Medbrans Ks".
The next count of the indictment again charges Edlira Malaj, together with Korab Lluka, with signing falsified and false documents with the intention of misleading the Tax Administration in order to justify the non-declaration of the invoice in the amount of 1,572,842,000 (1.5 million) euros.
Klodian Allajbeu is accused of having used three forged documents and sent them to the Kosovo Police with the aim of misleading the Police and the Prosecution for the purchase of equipment from "Medbrand KS" worth 4,703,999.98 euros, which was received by the Board of "American Hospital Kosova" on October 20, 2014, even though he was aware that on this date "Medbrand KS" did not exist as a registered entity.
The next count again accuses Edlira Malaj, Klodian Allajbeu and Igli Larashi, Ekrem Lluka and Korab Lluka of using forged documents to obtain illegal money worth 3,482,000.00 euros.
According to the indictment, the five defendants, using forged documents, managed to disguise and hide the nature of the true source, convert and transfer it from one business account to another, to personal accounts inside and outside Kosovo, to later take possession of and use it as legal money.
"So that the defendant Edlira Malaj, after establishing the entity "Medbrand KS", on 05.11.2014 together with the defendant Klodian Allajbeu and Ekrem Lluka, compiles the forged document "Sales Contract" dated 30.05.2014 according to which the legal entity "Medbrand KS" allegedly, with the aim of executing the aforementioned contract during 2015, issues two forged invoices dated 24.07.2015 in the amount of 1,572,842.00 euros issued by the "Kosovo Cardiac Center for "Medbrand KS" and the invoice dated 27.07.2015 in the amount of 4,709,999.98 euros, issued by "MEdbrand KS" for American Hospital Kosova", the indictment further states.
According to the indictment, Malaj had benefited from the amount of 3,131,158.00, where most of these funds were transferred and withdrawn to the Republic of Albania as dividends. Part of these funds were transferred to Austria to her and her son Rigers Malaj's accounts.
Thus, the indictment charges Klodian Allajbeu, Ekrem Lluka, Korab Lluka, Igli Larashi and Edlira Malaj with money laundering.
"From 10.08.2015 continuously until 2023, the defendant legal entities 1. "Medbrand KS" Sh.pk with responsible person and owner Edlira Malaj, 2. "American Hospital Kosova" Sh.pk with responsible persons and shareholder and legal representative Klodian Allajbeu and executive director Igli Larashi, 3.
"Kosovo Cardiac Center" Sh.pk with responsible persons, both owner and legal representative Ekrem Lluka and Korab Lluka, using forged documents described as in the provision "I to VII", manage to realize illegal income or money in the amount of 3,482,000.00 Euros, which money then, in order to appear legal, using the same documents, manage to mask and hide its true nature or source and convert it (buy real estate), transfer it from one business account to another business account, to personal accounts of the owners inside and outside the territory of the Republic of Kosovo and use it as legal money", the indictment further states.
