The Constitutional Court has issued a decision on a temporary measure for the constitutive session of the Assembly of Kosovo.
In the ruling issued in the evening hours, the Constitutional Court suspended every action and decision of the elected deputies regarding the constitution of the Assembly.
"TO DECIDE ex officio the temporary measure through which any decision and action of the elected deputies of the Assembly of the Republic of Kosovo regarding the Constituent Session is prohibited after the end of the 30 (thirty) day period," the decision states.
According to the same decision, the temporary measure will enter into force on July 27 and will last until August 8, when the Constitutional Court is expected to issue a decision following three requests that have been addressed to it.
"The Court considers that if an interim measure is not imposed ex officio against the decisions and actions of the elected members of the Assembly of the Republic of Kosovo after July 26, 2025, any decision and action taken after this date until the Court's decision regarding the requests may cause irreparable damage to the constitutional order of the Republic of Kosovo and the functioning of key institutions in the Republic of Kosovo," the reasoning of the Constitutional Court's decision states.
The Constitutional Court, in a decision a month ago, set a 30-day deadline, and in this case July 26, as the deadline within which the Assembly had to be constituted.
The interim measure was requested by the President of Kosovo, Vjosa Osmani, who on Tuesday addressed the Constitutional Court with a request for clarification of the legal consequences in the event of failure to constitute the Assembly within the deadline.
In addition to the president's request, two other requests from the Democratic League of Kosovo and the Democratic Party of Kosovo have also been submitted to the Constitutional Court, seeking an assessment of the constitutionality of the decision on the secret commission. The Constitutional Court has joined these requests.
The constitutive session of the Kosovo Assembly began on April 15 and has not concluded due to the lack of a political agreement and the lack of the 61 votes needed by the Vetëvendosje Movement to elect Albulena Haxhiu as speaker of parliament.
In addition, the Vetëvendosje Movement also insists on secret voting, which other parties reject.
