"We have consequences and damage to the heart", German citizens sue

Across Germany, according to lawyers, at least 185 civil lawsuits have been filed over suspected damages from the corona virus vaccination.

Two law offices in Düsseldorf and Wiesbaden, according to their statements, represent 135 and 50 of these cases. Lawsuits have been filed against the four main manufacturers of coronavirus vaccines: BioNTech, Moderna, AstraZeneca and Johnson & Johnson.

The first trial is expected to start on April 28 at the Frankfurt Court. Vaccine manufacturer BioNTech from the city of Mainz will be in the dock. The plaintiff is a woman who claims to have suffered heart damage as a result of vaccination against Covid-19.

The woman, who, according to her lawyer, is a medical professional herself, wishes to remain anonymous. Each claim will be dealt with individually or there will be some settlement out of court.

The main problem - the connection between vaccination and injury

In the opinion of lawyers and doctors, this issue will be finally decided by experts. The law firm from Düsseldorf has reportedly had around 3,000 lawsuit requests. These requests have resulted in 135 lawsuits, because not all of them had sufficient evidence to open cases. While the legal office from Wiesbaden says that there were 850 people who requested the opening of cases, of these they filed 50 lawsuits.

Even this office has rejected hundreds of requests, which are thought to be unfounded. According to experts in this field, these two law offices represent the majority of similar cases. A key issue in all of these lawsuits is the question of causation of the health damages and the evidence, if these damages are related to the vaccines.

In principle, the same liability rules apply to vaccines against the corona virus as to other medicines, according to the Medicines Act or the Product Liability Act. The manufacturer may be held responsible if there are any manufacturing defects. But if there was a mistake in the administration of the medicine, then the responsibility lies with the person who carried out the vaccination.

Düsseldorf lawyer Tobias Ulbrich expects a "battle of legal experts" - where it must be proven where the problem lies, understood if the courts do not immediately take any "judgments that would scare" other plaintiffs from pursuing these cases, he said. he for the dpa news agency.

BioNTech: Each case should be treated with caution

The BioNTech company states that "so far, in none of the cases examined by BioNTech has a causal link between the described health damage and vaccination been proven."

"We take our responsibility as a vaccine manufacturer very seriously," said the company's spokeswoman.

BioNTech, she explained, is carefully handling any cases in which lawsuits are filed against the company. However, it is a prerequisite that the lawyers submit sufficient documents to prove this connection. "When we evaluate a case, we can only rely on the medical facts to judge whether or not there is a causal relationship. Unfortunately, this is where documentation is often lacking."/Taken from DW
