Constitutional Court of Croatia: President Milanovic cannot take the post of
President Zoran Milanovic

Croatia's Constitutional Court ruled Friday that President Zoran Milanovic cannot take over as prime minister after this week's elections.

The court stated that Mr. Milanovic did not comply with a warning it issued in March that he should resign as president before re-engaging in the campaign to become prime minister.

President Milanovic has frequently criticized the European Union and NATO and opposed aid to Ukraine in its fight against Russian aggression.

Prime Minister Andej Plenkovic's ruling conservative party, the Croatian Democratic Union (HDZ), won Wednesday's election, taking 61 seats in parliament but falling short of the majority needed to govern alone, prompting other parties to begin negotiations to formed a governing coalition.

The coalition led by the opposition Social Democratic Party of Mr. Milanovic came second with 42 seats in the assembly. This result dimmed the possibility of President Milanovic becoming prime minister, but Friday's decision precludes such a possibility even if it would secure the support of smaller parties.

The far-right group Lévizja Vendlindja came third with 14 seats, a result that could give it a decisive role in creating a coalition with the Croatian Democratic Union.

"With his statements and actions, the president of the republic... has placed himself in a position where he can neither become a representative of the future government nor Prime Minister", the Court's decision states.

President Milanovic dissolved the Croatian parliament on March 18, prompting early elections this week, and declared he would run for prime minister and resign as president only after winning the election. The Constitutional Court has since declared that he was obliged to resign before the elections.

The final results of the elections are not expected until next week as voting will be repeated in two areas due to irregularities.
