Millions of square meters in the two Albanian peninsulas, Karaburun and Cape Rodoni, are trying to be hijacked by an organized alliance between crime, the judiciary and politics.

Greed has also affected clergy or religious organizations.

The crime starts from the falsification of documents, from judicial, formal proceedings to threats and threats to anyone who tries to set up barriers and disrupt the scenario to "get hold of" the coastal area, one of the best in the country.

The road to Cape Rodon passes through a coastal area, highly coveted in recent years.

After leaving the Tirana-Durres highway in the Maminas area, you head towards Hamallaj. The pine belt has already been narrowed by mansions and villas, pushed up to the sandy shore.

After Lalzi Bay, it's Cape Rodoni's turn. The influence of power, but also of crime, has left it outside the "Protected Landscape" status. The National Agency of Protected Areas and the Ministry of Environment have proposed that the 1,500 ha peninsula be protected by the state. The proposal remained only on paper.

In the area there is only one natural monument, Maja e Kepi i Rodoni, and two cultural monuments, Skenderbeu Castle and the church of Saint Ndoji.

After passing the village of Shetaj, in the direction of the Cape, a beam is placed at the entrance. The end of Cape Rodon, the wooded one, is fenced and at the entrance there is a sign: "Private property of the Albanian Franciscan Church ". You have to buy the ticket to get inside the peninsula.

At the entrance are the same people who clashed at noon on October 29, 2023. On that day, the former deputy, Mark Frroku, with some guards, were beaten with the villagers. The former MP tried to surround the properties of the villagers, which they have with ownership certificates. The police arrested both parties for "Deliberate grievous bodily harm", "Self-judgment", "Threat", "Criminal failure", "Actions that prevent the discovery of the truth" and "Disturbance of order". The police officially said that a firearm casing was also found at the scene. "Regarding the claims of the parties regarding the ownership certificates, the materials have been referred several times to the prosecutor's office", - asserted the police.

The conflict is over a land with two ownership certificates. The Kaculi family has acquired 5,470 meters of land with Law 7501. In the Cadastre, the property has asset number 30\6. Bajram Kaculi, one of the many who was detained for several hours by the police at the end of October, says that people want to take his property, for whom he has no idea what they represent.

"At their head is Ndue Sokoli, the brother of the lawyer who protects the interests of the Franciscan Province, Gjergj Sokoli. We have been busy several times. But, on that day, there was also the former deputy, Mark Frroku, and other armed people", - says Kaculi for INA Media.

According to the police, former deputy Mark Frroku wanted to surround the property, with two owners. He was arrested and released after a few days.

"Self-judgment" and "Illegal Possession and Production of Explosive Weapons and Ammunition", proceedings, which are under investigation. Investigations into these criminal cases continue with priority and at the end of them, the parties in the process will be notified of the prosecutor's decision-making, according to the provisions of the Code of Criminal Procedure", - it is written in the response of the Durrës Prosecutor's Office to INA Media, on the date February 28, 2024.

The former MP was previously investigated and tried for murder, money laundering, concealment of wealth and illegal construction.

The Prosecutor's Office of Tirana asked for 25 years in prison, but the court sentenced him to 6 years, removing the charge of murder. After the conviction, Frroku left politics, running his own businesses.

In 2016, the Prosecution for Serious Crimes started investigations after suspicions that part of his wealth was created from illegal sources, mainly from criminal activity in the field of drug trafficking and prostitution".

In 2021, the KRRT granted permission to the AM-L Group company, owned by Mark Frrokut, for the "Construction of a wind power generating plant with a capacity of 2 MV" in Pukë. Once, Mr. was also a shareholder in this company. Arben Frroku, accused of murdering the police officer, Dritan Lamaj.

For the event of October 29, 2023, Frroku stayed in the cell for 72 hours, as he was released by the court under the "Compulsion to appear" measure. He said that he was contacted by the Franciscan Province, which has a property certificate in the village of Shetaj, with property number 31 and with an area of ??4,114 square meters. But the maps of both properties, that of the Kaculi family (5,470 square meters) and that of the Franciscan Province (4,114 square meters) are in the same place; with a deployment plan. The Province says that the Kaculi family does not have it there, while the Kaculi family says that the Province has been expropriated for this property.

Ana Shtjefni, administrator of the company Albania Tourist Resort, managed this property, with a contract with the Franciscan Church, which included the fencing of the property, as well as its use.

"My firm is still the representative of the Franciscan Province for that area. I was forcibly removed by individuals with a criminal past. I had a physical conflict with the guards, led by Ndue Sokol. They sent me away because I refused to surround the properties of the residents of Shetaj village, even of the Kaculi family. They have regular ownership certificates", says Ana Shtjefni.

According to her, the October conflict is the "tip of the iceberg", as with decisions and civil and administrative processes people close to Franciscan Province are trying to take a significant area from the state, outside the already surrounded area.

There are about 30 court proceedings, civil and criminal, registered in the Court of Durrës.

"A dubious deal has been made, where some people are trying to get millions of square meters all over Cape Rodon. Personally, I have documents for a trial started in the Court of Durrës, where the lawsuit was filed by the lawyer of this Province, Mr. George Sokoli.

The latter is the brother of Mr. Ndue Sokoli, who is standing at the entrance to the Cape together with several people", says Mrs. Shtjefni.

INA Media browsed dozens of lawsuits filed in the Court of Durrës, where an attempt is being made to privatize a state-owned super-property of millions of square meters.

According to the document, in 2019, the French Province sued the Ministry of Finance and Economy, the Council of Ministers, the Property Management Agency and the Municipality of Durrës and demanded recognition as the owner of 5,586,363 m2 of "forest and pasture" in the village of Shetaj , Durres.

The area, which this Province is looking for, lies in the southern part of Cape Rodon, an untreated forest with Law 7501. The area includes the most beautiful beaches of the Cape, precisely the "white beach" and extends to Saint Peter, on the border with the Gulf of Lalzi.

"Besides the trial, the document of origin is also suspicious. The province has no right over this property, since with just one name in a document of theirs, the old people are taking all this property", says Ana Shtjefni.

She alludes that the people who clashed in October, led by the former MP Frroku or others with criminal records, demand the administration of this property.

"All their focus is on this asset. They have put a genuine mechanism into play, starting with lawyer Gjergj Sokoli, who has been an investigator at the Durrës Prosecutor's Office. Then they gathered political figures", - adds Mrs. Shtjefni.

Currently, most of the surface, which the Province requires, belongs to the state. Several premises have been built, with a 30-year lease from the Municipality of Durrës.

Arbeni Resort, on the southern side of Cape Rodon, on the coast of the Adriatic Sea, is owned by 3 members of the Alla family, Vath, Xhaferr and Selim Alla, as well as Romeo Çupin, each with 25% of the shares.

In the act of establishment of the company, it is written that the duration of the activity of the company is for 30 years. In 2018, the former prime minister, Sali Berisha, wrote on his FB profile: " Property is being destroyed by incriminated and previously convicted persons, Vath Alla, with the permission of Vangjush Dako. They have cut down trees, thrown inerts inside the property of the Church, to build in a farm, which they claim to have rented from the municipality .

In June 2019, the name of the shareholder of this resort, Vath Alla, appeared in the interceptions of file 339, published by the German newspaper, Bild. The interceptions were between Astri Avdylaj, sentenced to 12 years of imprisonment for drug trafficking, and the former mayor of Durrës, Vangjush Dako.

"In this interception, Astrit Avdylaj calls Dako. From the conversation, it appears that Astrit Avdylaj is at the Real Estate Registration Office, in Durrës, in the presence of the director of the office and Vath Alla, a former convicted of murder, to "finish" a job for Alla's account.

It goes on to say that Avdylaj asks Dako to "cancel his plans to travel to Ishem, to ensure that the 'job' that Alla is looking for is completed at the Mortgage office by the director, who calls Alla and then Dakon to meet with him and the convicted murderer, Vath Alla. Dako accepts and changes the agenda", writes the German newspaper, Bild.

The residents, with whom INA Media spoke, who wished to remain anonymous out of fear, said that characters from the world of crime, such as Aleksandër Laho, known as "Rrumi i Shijaku", have also been seen in the area.

"He moved to the area 3 years ago. After declaring him wanted two years ago, we saw his brother, who was the director of a directorate in Durrës", - claims a resident.

On November 1, 2021, Laho was assassinated on the Tirana-Durrës highway. He was traveling together with prosecutor Arian Ndoja. Both were injured, while the driver, Andi Maloku, died.

A year later, in November 2022, the Special Court issued the security measure "Arrest in prison, in absentia" for Aleksandër Laho, on the charge of corruption for the file of alienation of properties in Lalzi Bay. Currently, his case is being tried in the Special Court. This court seized over 400,000 square meters of land on the coast, which it was suspected that "Rrumi i Shijaku" had obtained with false documents. 200 thousand square meters in Lalzi Bay and 203,100 square meters in the village of Shetaj, in Ishem.

In SPAK's file there are also 2 videos recorded in 2017, where "Rrumi" is shown shopping and bribing Irgen Kirçuk, representative of the State Attorney, to withdraw from the appeal of the judicial process of property alienation .

Skema është e njëjtë edhe me proceset që janë në gjykim, ku Avokatura e Shtetit thuajse i ka braktisur dhe nuk merr pjesë, madje edhe në gjyqin prej 5.5 milionë metrash katrorë në Gjykatën e Durrësit.

INA Media i ka dërguar një kërkesë për informacion Avokatit të Shtetit, por ky institucion refuzoi të përgjigjej.

“Dyshimet janë se mund të ketë ndonjë marrëveshje mes njerëzve, që po i rrinë tani afër, për të marrë apo për të ndërtuar në atë pronë”, – thotë Ana Shtjefni.

Mega-procesi i pronës në Kepin e Rodonit, që ka pasur një të ngjashëm edhe për pronat në Hamallaj, ka shkuar deri në Gjykatën e Lartë. Gjyqtarët e Shkallës së Parë e kanë dërguar direkt në “kupolën” e gjyqësorit.

Çështja është regjistruar në Gjykatën e Lartë më 19 maj 2021, me shpjegimin: “Ardhur prej Gjykatës së Shkallës së Parë, Durrës”. Pasi është caktuar edhe relatori, gjyqtari Ervin Pupe, çështja është “në pritje” për t’u gjykuar!

Sërish, palë janë Provinca kundër Këshillit të Ministrave, Ministrisë së Financave dhe Ekonomisë, Agjencisë së Trajtimit të Pronave apo edhe kundër Bashkisë së Durrësit. Objekti i padisë\akuzës është: “Detyrimi i palëve të paditura për të njohur pronarin e pasurisë 5.5 milionë metra katrorë”.

Kur në terren kanë plasur armët dhe në të tria shkallët e gjyqësorit po zhvillohen beteja influencash, në pjesën veriore të Rodonit kanë “mbirë” edhe resortet e para. Në afërsi të pronës “mollë sherri” është ndërtuar fshati i parë, turistik me vila një apo dykatëshe. Resorti quhet Cape of Rodon. Komiteti i Investimeve Strategjike i dha kompanisë Premium Finance Invest, më 15 korrik 2021, 1.086.6 ha në zonën e Kepit të Rodonit, Durrës, për vetëm 1 euro!

Vendimi mban numrin 6/5 dhe ka një emërtesë: “Për miratimin e statusit investim/investitor strategjik – procedurë e veçantë për projektin e investimit me potencial strategjik Cape of Rodon, faza 1, i propozuar nga subjekti Premium Finance Invest”.

Përpara se të merrte statusin e Investitorit Strategjik, firma kishte si aktivitet të saj bixhozin.

Në vendimin e AIDA-s  shkruhet se, projekti parashikon ndërtimin e hoteleve, të vilave, të rezidencave, të fushave të golfit dhe të shërbimeve të ndryshme. Por, firma që u shpall investitore, nuk ka pasur dakordësi për të gjithë këtë sipërfaqe. Ajo u detyrua, që ta ndajë projektin në disa faza të ndryshme.

“Masa kryesore, mbështetëse, që kërkon subjekti nëpërmjet procedurës së veçantë, për të cilën aplikon, është që projekti të miratohet me ligj të veçantë, por projekti i dorëzuar për sipërfaqen prej 1.086.6 ha nuk u vlerësua ende i maturuar për këtë masë mbështetëse”, shkruhet në vendim.

Fjalët e përdorura në këtë vendim janë të zgjedhura dhe nuk bëjnë fjalë për një refuzim, pasi “subjekti e ka ndarë projektin me faza dhe faza e parë, për të cilën aplikon dhe plotëson kriterin financiar, ndahet në katër nënfaza”.

Karaburuni, një mal dokumentesh “false” për të rrëmbyer gadishullin

Dy faqe letër në formën e një vendimi të Gjykatës së Vlorës, të firmosur nga Thoma Nika, më 29 dhjetor të vitit 2000, shpallën pronar të 220 hektarëve në gadishullin e Karaburunit varrmihësin e qytetit të Vlorës, Raimond Mëzin. 

Në vendim argumentohet se në prill 1996 Agjencia e Kthimit të Pronave i ka refuzuar kthimin e pronës Raimond Mëzit, duke i mohuar kështu një të drejtë të tij, kushtetuese. 

Ky vendim u konservua 12 vite. Në vitin 2012, sipërfaqja prej 220 hektarësh është regjistruar në emër të Raimond Mëzit. 

Po në këtë periudhë në Zvërnec sërish në emër të varrmihësit, Hipoteka regjistron edhe 89 hektarë të tjerë.

Këtë radhë si dokument për regjistrimin e pronës shërbente një vendim i gjyqtarit të ekzekutuar në mënyrë mafioze në Vlorë, Skerdilajd Konomi. 

Për dy vite me radhë asnjë transaksion nuk është kryer në emër të Raimond Mëzit.

Edhe pse pothuajse njeriu më i pasur në Vlorë, me qindra hektarë tokë në zonën më të bukur të vendit, INA Media mësoi se Mëzi jetonte në një banesë të varfër, në lagjen Partizani, në Vlorë.

Më 2 tetor 2014, në Zyrën Vendore të Regjistrimit të Pasurive të Paluajtshme në Vlorë, pasuria prej 220 hektarësh është ndarë në dy sipërfaqe.

90 hektarë dhe 130 hektarë. Një javë më pas, më 10 tetor 2014, përfaqësuesi me prokurë i Raimond Mëzit, avokati Enkes Hysendhima, iu ka shitur 90 hektarë kompanive House of Arts dhe Digitalnetworks për 180.000 euro.

House of Arts është kompania e ish-deputetit socialist, Fidel Ylli, që administrohet nga Elida Heba dhe merret me organizim eventesh; ndërsa Digitalnetworks zotërohet nga biznesmeni Gerian Kuka, njëherazi Konsull Nderi i El Salvadorit në Shqipëri.

Pjesa e mbetur prej 130 hektarësh në Karaburun shkëmbehet me Artur Shehun – një personazh kontrovers i viteve të tranzicionit në Vlorë, i cili jeton prej dy dekadash në Florida të SHBA.

Kontrata e shkëmbimit, e kryer më 4 dhjetor 2014, mban firmat e Enkes Hysendhimës, përfaqësues me prokurë i Raimond Mëzit, dhe Pëllumb Petritajt, përfaqësues i Artur Shehut. 

Petritaj e ka ndarë pronën në 4 pjesë përgjatë periudhës mars-tetor 2015. Në mars të vitit 2015, pesë hektarë i janë shitur për 9 milionë e 850 mijë lekë Arian Laçit, një tjetër biznesmen kontrovers, i dënuar në Itali për trafikimin e lëndëve narkotike; ndërsa në janar 2016, Pëllumb Petritaj ka shitur 20 hektarë te biznesmeni vlonjat, Thodhori Gjiknuri, për 39 milionë e 600 mijë lekë.

Të njëjtin fat pësoi edhe sipërfaqja prej 89 hektarësh. Të gjitha kontratat janë nënshkruar në një periudhë të shkurtër, kohore dhe tek i njëjti noter. Po kaq e shkurtër ka qenë edhe koha e regjistrimit të tyre te personat e tretë. 

Kur ka përfunduar operacioni i parë i tjetërsimit të kësaj sipërfaqeje, familja Bodo, pretendente për një sipërfaqe toke në Karaburun, në janar 2016 dorëzon në prokurori denoncimin për tjetërsim pronash.

Në shkurt të vitit 2016, prokurori i Vlorës, Albert Kuliçaj, urdhëron arrestimin e Raimond Mëzit, në emër të së cilit është regjistruar prona, të avokatit të tij, Enkes Hysendhima, të ish-punonjëses së Hipotekës së Vlorës, Blerina Dhrami, të noteres që kishte kryer transaksionet e shitblerjes, Belona Seraj, si dhe të Donika Besimajt, përgjegjëse e Arshivës në Gjykatën e Vlorës; të gjithë të përfshirë në skemën e falsifikimit të dokumenteve.

Në qershor 2016, Prokuroria e Vlorës shpalli në kërkim edhe biznesmenin Pëllumb Petritaj, përfaqësuesi i Artur Shehut, si i përfshirë në këtë skemë falsifikimi. Por, në korrik 2017, kur prokuroria dorëzoi në gjykatë kërkesën për gjykim, Petritaj dhe një notere u përjashtuan nga akuzat.

Zanafilla e falsifikimeve të njëpasnjëshme ngrihet mbi një vendim të vitit 1996 të Komisionit të Kthimit dhe të Kompensimit të Pronave në Vlorë, sipas të cilit Jakup Mëzit, babai i Raimond Mëzit, i njihet një sipërfaqe prej 6.600 metrash katrorë tokë. Mbi këtë dokument është prodhuar një tjetër dokument fals, që njeh familjen Mëzi si zotëruese të sipërfaqes prej 220 hektarësh.

Dokumentet tregojnë se sipërfaqja e pronës, e përfituar në mënyrë të jashtëligjshme, është tjetërsuar te të tretët nëpërmjet kontratave fiktive të shitjes. Pronari, në emër të së cilit është regjistruar prona 309 ha, Raimond Mëzi, e kthyer, në Karaburun dhe në Zvërnec, nuk ka aplikuar kurrë në Zyrën e Regjistrimit të Pasurive apo në gjykatë për këtë pronë. Para prokurorëve ka deklaruar se, te noteri ka firmosur fletë të bardha.

Emri i Raimond Mëzit është përdorur vetëm për sigurimin e pronës, e cila më pas është shitur nga Enkes Hysendhima, falë një prokure përfaqësimi.

Varrmihësi i qytetit të Vlorës, jetim, është birësuar nga Jakup Mëzi, kur ishte vetëm 1 vjeç.

Në vitin 1994 ai ka kërkuar në Agjencinë e Kompensimit dhe Kthimit të Pronave pronësinë e sipërfaqes 61.400 m2 tokë në qytetin e Vlorës. Gjyqtari Thoma Nika ka deklaruar se kurrë nuk ka zhvilluar një proces të tillë, gjyqësor. Vendimi i gjyqtarit të ndjerë, Konomi, sipas prokurorisë, është i falsifikuar. Madje, prokuroria dyshon se e gjithë dosja gjyqësore është falsifikuar. 

Dosja penale është në Gjykatën e Apelit, sepse Prokuroria e Vlorës mbeti e pakënaqur nga Gjykata e Faktit, e cila, në mars 2018, shpalli fajtorë katër nga pesë të akuzuarit për falsifikimin e pronës në Karaburun.

Trupi gjykues, i përbërë nga Albert Spiro, Albana Selmanaj dhe Laurent Fuçia, shpalli përgjegjës kryesor Raimond Mëzin dhe vendosi dënimin e tij me 18 vjet burg. Avokati i tij, Enkes Hysendhima, i cili akuzohej nga Prokuroria e Vlorës si një ndër protagonistët e falsifikimit të tokës, u shpall i pafajshëm nga trupi gjykues. Prokuroria kishte kërkuar dënimin e Hysendhimës me 24 vjet burg. 

Betejat në gjykatë

Mëngjesin e së premtes, më 22 qershor 2017, Vjosa Bodo, e shoqëruar nga xhaxhai i saj, Isufi, zuri vend në karriget e para, të vendosura për publikun në komisionet e vetingut.

Seanca dëgjimore ishte për personin, që ata e bënin përgjegjës për mohimin e së drejtës së pronës, gjyqtarja Brikena Ukperaj.

Vetingu për gjyqtaren, e cila kandidonte për në Këshillin e Emërimeve në Drejtësi, ishte shansi i fundit për familjen Bodo. Në nëntor të vitit 2017, Gjykata e Apelit të Vlorës, ku Ukperaj ishte relatore e çështjes, rikthehu për gjykim një çështje, që Vjosa e konsideronte një betejë të fituar.

Bëhej fjalë për një padi civile, që familja Bodo kishte hapur që në janar të vitit 2016.

Në prill të vitit 2017, Gjykata e Shkallës së Parë, Vlorë pranon aktpadinë e vëllezërve Bodo, duke shpallur se tjetërsimi i pronës është bërë nëpërmjet dokumenteve të falsifikuara.

Pjesë e vendimit është edhe kthimi i një sipërfaqeje totale prej 404 ha tokë në Karaburun trashëgimtarëve Bodo, si dhe rregullimi i pasojave të krijuara në Zyrën e Regjistrimit të Pronave si rezultat i kontratave të shitblerjes.

Vendimi ankimohet në Gjykatën e Apelit nga Zyra e Regjistrimit të Pasurive, si dhe nga dy kompanitë private, të cilat rezultojnë dhe përfitueset e pronës.

7 muaj më vonë trupa gjykuese, e përbërë nga Skënder Damini, Gjinovefa Gaba dhe nga relatorja, Brikena Ukperaj, e rrëzon vendimin, duke argumentuar se është marrë në shkelje të rëndë të një sërë normash procedurale.

Për shkeljet e konstatuara në këtë vendim Gjykata e Apelit vendosi më 11 nëntor 2017 rikthimin e çështjes në gjykim me një tjetër trupë gjykuese.

Por, dhe pse vendimi është marrë nga një treshe gjyqtarësh, familja Bodo akuzoi relatoren e dosjes se kishte shkelur afatet ligjore. Gjyqtarja e kaloi procesin e vetingut, por çështja e pronave, ku ajo ishte implikuar, është ende në proces gjykimi.

In February 2022, another panel of Appeals, Vlora upheld the decision of the Judicial District Court and ordered the deregistration from the mortgage registers of all the property acquired by the gravedigger and alienated through sales contracts. The decision recognized the co-ownership of the Bodo brothers, as well as the return of 404 ha of forest land in Karaburun. However, on August 12, 2022, the State Bar asks the court to suspend the decision on the deregistration from the mortgage registers for the alienated property in Karaburun. 

The State Advocacy argues that, "we are facing the existence of a risk that could cause serious and irreplaceable damage to state interests, based on the fact that the Local Real Estate Registration Office, Vlora has notified the State Advocacy about the registration of the property in favor of the Bodo family. The State Bar claims that this property will be alienated and therefore the suspension of its registration in the Mortgage of Vlora should be decided".

The request of the State Bar was rejected by the Supreme Court College.

In the reasoned decision it is stated that, "The State Attorney's Office has not presented any concrete reason or argument, based on evidence, that the immediate execution of the decision would bring reparable consequences" for the property, which only after 28 years the Bodo family can this a court decision, which recognizes the right of ownership.

The Bodo family's properties are registered in state cadastres, although the two main companies that have benefited from the land through transactions have taken the case to the Supreme Court. The timing of this appeal is not yet known, as this court is still reviewing cases sent in 2017. The appeal of Digitalnetworks and House of Arts is filed in July 2022.

It seems that the legal battle for the Bodo family is not over yet, but at least they are now recognized as the rightful owners. A piece of paper, that the Malo Bodos had to fight for more than 30 years.

A certificate of ownership, which Malo Bodo could not see while he was alive. He passed away on November 24, 2021, 3 months before the Court of Appeal of Vlora decided justice for his family.
