How the Constitutional Court is being destroyed by Sokol Sadushi's illegal tricks

The Constitutional Court and the High Court, which represent the pinnacle of the judicial system, have been driven into a dead end by a single man; Sokol Sadushi! The President of the High Court, who should have been a person of integrity and respected by all, where his word had weight, seems to have been made a “meme” by his own colleagues. One vote in the High Court, for the election of a member of the Constitutional Court from its ranks, was enough to show the chaos that the system carries, which seems to have “stinked from the head”.

We have often seen, read and heard of corruption in parliamentary or local elections. We are witnesses of scandals in the elections of the Order of Psychologists, of Dentists. Scandals also in the elections for the head of the Albanian Football Association, or the presidents of clubs. All of these, and in other areas, only reinforce the idea that Albanians do not know how to make honest elections.

But it seems that the September 30 vote in the Supreme Court has only put a lid on all the voting processes. The cream of the judiciary has not been able to conduct an honest and fair vote with only 15 people. The process has a multitude of violations, starting from the orders of the President of the Supreme Court, Sokol Sadushi, who set up the commission with civil servants, secretaries who are subordinate to him. These servants decided on the judges' vote!

A great paradox, since civil servants are appointed, while judges are elected! But, the "law" in the Supreme Court is made only by the president, and not by the legislators with what they have written. But, the scandal continues that the technical commission with the secretaries decided on the validity or not of the judges' votes. It is precisely these "experts", who seem to have received orders directly from their superior, fearing for their jobs, implemented Sadushi's plan; 1 invalid vote, which brought down the entire process.

In this case, names are not more important than the process. Not knowing how to make choices, even in the dome of justice, means that every reform undertaken so far to reform the entire justice system is thrown "in the trash". How is it possible that one candidate receives more votes than the other, and the second one wins the seat?

But, Sadushi's decision to send his "man", Asim Vokshi, to the Constitutional Court has brought confusion to the entire system. An irregular process that brings about the destruction of the court, which should protect the fundamental document of the state; the Constitution! The culprit is one and only, Sokol Sadushi, who with his maneuvers will bring the entire system to collapse. He has "ordered" who should stay in office, who should leave office and who should be elected member of the Constitutional Court.

It even "presses" on which members should vote and which should not, despite the fact that the law and regulations that have been approved specify it quite clearly. It seems to be a scheme orchestrated by Sadushi's office, who is attempting to run the two main courts.

The vote of the Constitutional Court a few days ago, forcefully requested by the Supreme Court itself and its president Sokol Sadushi, only put the entire system in a major legal impasse. The Constitutional Court made a highly controversial decision, shortening the mandates of 5 out of its 9 members. The decision is nothing more than a "capture" of the entire system, where the Sokol Sadushi clan is trying to remove the unwanted in order to send its "people" to that court.

The Constitutional Court's decision directly affects the mandates of Judge Sonila Bejtja and the judge who resigned in 2024, Elsa Toska. The members of the Constitutional Court have decided by majority vote that the mandates end in 2025, when in fact they should have ended in 2028. Controversial decisions in the dome of justice, where attempts are being made for people close to large interest groups to occupy key positions, ahead of important processes that are underway and will take place in the Constitutional Court.

According to the Constitutional Court's calculations, in addition to Bejtje and Toska, the mandate of members Fiona Papajorgji and Marsida Xhaferllari is also affected, as is the mandate of Ilir Toska. The reason is that the Constitutional Court says that their mandate "began" at the moment their predecessors left office and not from the date these members started. Another paradox, since the mandate begins at the moment of the decree date.

But, the wonders in this small country of ours keep coming and going, but no one is impressed anymore. The consequences are very fatal, with a very fragile judicial system and in the "hands" of a few individuals, who are guided by politics. And, as long as politics has stuck its "noses" deep into justice, we will have exactly this system that we have, where large groups (not in the judiciary) influence which judges they will appoint and whom they will dismiss.
