With the opening of the parliamentary proceedings in January, the declaration of the invalidity of the mandate of deputy Arben Ahmetaj is expected, and his replacement with another deputy, based on the winning list of candidates in the 2021 parliamentary elections.
According to the rules of the assembly, the new parliamentary session begins on the third Monday of January. The beginning of the new parliamentary session takes place with a plenary session called by order of the speaker of the parliament, Lindita Nikolla. From the verification of the mandates, it is expected to establish the invalidity of the mandate of Arben Ahmetaj, referring to Article 71 of the Constitution.
This article sanctions in its point 2 that the mandate of the deputy expires or is invalid when he is absent without reason for more than 6 consecutive months in the Assembly. For the last time, former minister Ahmetaj was present at the plenary session on July 6.
Four days later, SPAK requested authorization from the Assembly for the removal of immunity and the arrest of the former number two of the government, Arben Ahmetaj. At the meeting of the Council of Mandates, the defense lawyers of the former minister stated that he was abroad. In the session where his colleagues authorized the Special Prosecutor's Office to arrest Ahmetaj, the latter was not present but sent a public message from the escape.
Referring to this chronology, Ahmetaj has fulfilled the time limit set by the constitution, so the finding of the end of his mandate is expected. According to the preferential votes of the candidates in the 2021 parliamentary elections, Ahmetaj's mandate passes to Dallandyshe Bici, the current director of the State Cadastre Agency. If the latter does not accept the mandate, then it passes to the lawyer Plarent Ndreca, who secured 4008 votes in Tirana in the 2021 elections.
