Each construction project must be evaluated by the relevant state institutions regarding the fulfillment of design criteria or technical construction rules.

This means what is known as technical opposition. Specifically, with a decision of the government a few days ago that has already been published in the Official Gazette thus entering into force, the fees for each project have been approved based on its total value.

The decision determines as a start that the technical opposition is carried out for the project for the approval of the construction permit and for the implementation project, depending on the type of object and construction works, according to the provisions in article 6, of law no. 8402, dated 10.9.1998, "On control and discipline of construction works", amended.

"The technical opposition aims to control the project in accordance with the design task, with the planning and development control documents, with the technical rules of construction, the technical conditions, the Albanian standards in force or the European standards when the Albanian standards used in the project are missing , as well as with the legislation in force that regulates the construction activity in the Republic of Albania" the decision states.

The same specifies the areas that have the obligation of opposition.

The technical opposition is carried out for study-design in the fields: a) social, cultural, health, educational, scientific, sports and cemeteries; b) infrastructural; c) hydraulic; ç) energy transmission; d) engineering networks; dh) waste collection and treatment; e) residence and service; e) industrial; f) agricultural; g) financial; gj) administrative; h) accommodation and recreation.

Opposition fees

The decision clarifies that the technical opposition is developed by the respective state institutions for each field against a fee.

Thus, the opposition fee for construction works projects is calculated as a percentage of the design fee where the calculated costs are taken for the typology of the service. The design fee for the calculation of the opposition is taken in the value according to the provisions in VKM no. 354, dated 11.5.2016, "On the approval of the fee manual for services in territorial planning, design, supervision and approval".

"The phases for calculating the fee are taken from phase I to phase VI for all typologies of services, while for underground works and foundation works they are taken from phase I to phase III, according to the provisions in VKM no. 354, dated 11.5.2016, "On the approval of the fee manual for services in territorial planning, design, supervision and approval".

The opposition fee for constructions with a calculated cost below 50 million ALL are on an increasing level increased by the coefficient of change, for buildings with a calculated cost from 50~300 million ALL, intermediate fees are obtained by linear interpolation, while over 300 million ALL are immutable.

The fee for opposition that takes place in two phases, opposition for the permit project and opposition for the construction project for the second phase is calculated with the applicable percentage rates for the service phase defined in point 2 of annex 1 of this decision, must to be reduced by 50%.

In various cases and for objects of particular importance, when the opponent also opposes changes to the project during the implementation of the works, the fees are increased by 20%", says a decision.

The percentage fees for the opposition refer to the costs calculated according to the table.
