The law on the Intelligence Agency changes. What does the draft envisage?

The government has decided to revise the law on the Defense Intelligence and Security Agency, an institution subordinate to the Ministry of Defense, issuing for consultation the draft with a number of changes.

According to the report, it is clarified that the purpose of these legal changes is to enable the entire structure to carry out its mission in support of the law, to regulate relations with other law enforcement structures and to improve the financial treatment of employees.

The report clarifies that the proposed changes have been made by referring to the relevant legal framework of NATO countries, such as Croatia, starting from the approximations in the mission, tasks, numerical composition, etc., as well as consultations with the allies.

The changes come under the conditions of a reformed justice system, where some of the institutions have undergone reorganization in recent years, and the Agency would also have to adapt to the new conditions.

"During these years, the operation of this law has encountered problems related to the implementation of some attributes that this legal act should provide to the Defense Intelligence and Security Agency in the realization of its mission. The change of this law is also a consequence of changes in the justice system and in other institutions, such as: the prosecution, the courts, the creation of SPAK, the issuance of the law on the State Police and AMP, institutions with which the Intelligence Agency and Security of Defense cooperates for the realization of its mission", it is stated in the relation.

Use of systems and staff

The draft law sets out the conditions that must be fulfilled by the persons who become part of the Agency from the highest to the lowest levels. It also sanctions that the Agency can use systems of other institutions such as edpshtrr which is the system of the General Directorate of Road Transport.

"The Defense Intelligence and Security Agency, in fulfilling its mission, uses and utilizes the edpshtrr system. The method of use and the specific procedures are determined by a joint instruction between the minister responsible for defense and the minister responsible for transport, with the proposal of the director general of the Defense Intelligence and Security Agency." It says in the draft.

Meanwhile, another system is TIMS

"The Defense Intelligence and Security Agency, in fulfilling its mission, uses and exploits the databases of the TIMS system. The methods of use and specific procedures are determined by joint instruction between the general director of the Defense Intelligence and Security Agency and the general director of the State Police, with the proposal of the general director of the Defense Intelligence and Security Agency", it is stated in draft law.
