Germany urgently needs skilled workers from abroad. The rules for immigrants from non-EU countries are changing step by step. A summary.

German employers are short hundreds of thousands of workers: in IT as well as nursing, crafts, technology, logistics and many other sectors. The "Law for the Further Development of Skilled Immigration" passed in the summer aims to immediately reduce the obstacles to the immigration of skilled workers from so-called third countries, i.e. non-EU countries, to Germany.

The first changes will apply from November 18, 2023

Specialists with a university degree, or a similar qualification level, coming from third countries, i.e. outside the EU, can immigrate to Germany with an EU Blue Card - without first checking whether there are German aspirants or citizens of EU for the workplace and without proof of language skills.

Salary limits to avoid abuse of specialists coming from abroad will be reduced to 40,000 euros per year for professions where there are more shortages and 44,000 euros for all other professions (from 2023).

The list of occupations with shortages (previously: mathematics, computer science, natural sciences, engineering and medicine) has expanded and now includes, among others, education and nursing staff.

For the IT industry, skilled workers without a university degree can also obtain an EU Blue Card if they can prove that they have comparable professional experience of at least three years.

Right of residence, more flexibility

Whoever meets all the conditions as a qualified employee with professional or academic training has the right to receive a residence permit. Until now, this was left to diplomatic missions and immigration authorities to decide.

In addition, the restriction to work in the professional field that you have learned or studied is removed. A person who has graduated as a mechanic, for example, can also work in logistics. Exceptions are regulated professions, for example in the field of medicine, law or teaching.

It also makes it easier to get approved by the Federal Employment Agency for professional drivers. The work permit is issued without checking if there are EU citizens who are looking for this place and without a language test.

Emigration with work experience

Recognition of professional qualifications in Germany, which previously was often a bureaucratic hurdle, will no longer be required for experienced specialists.

Anyone who has a state-recognized professional qualification in the country of origin and has at least two years of professional experience in it can immigrate to Germany as a worker. Regulated professions are excluded from this. IT specialists do not need a degree.

Qualification recognition partnership

Those who need an additional qualification in Germany to achieve qualification equivalence will be able to stay in Germany for up to three years in the future. Applicants are allowed to work up to 20 hours per week while they are doing the equivalent education.

The opportunity to work part-time is also expanding for students and trainees. If employers in Germany and applicants from third countries establish a recognition partnership, qualified workers can come directly to Germany and work while the process for recognition of their qualification is ongoing. The stay can be extended up to three years. They must have at least two years of professional qualification and knowledge of the German language (level A2). In addition to nursing staff, assistant nurses with less than three years of nursing training will also be given access to the German labor market in the future.

Family reunification

If the workers will be joined by spouses and minor children, they must prove that the income is enough to live, but not that they have the right area for housing. They can also bring their parents or in-laws to stay with them if they get their residence permit after March 2024.

What comes into effect on June 1, 2024?

Job search opportunity card

The opportunity card with a points system will come into use for the first time in June 2024. With the opportunity card (Chancenkarte), people can come to Germany to look for work for one year, if they have enough money to live.

Anyone who can prove the equivalence of their qualifications to German ones is considered a skilled worker and receives the card without any further requirements.

All others need a university degree or a professional qualification of at least two years, as well as basic knowledge of the German language (level A1) or knowledge of the English language (level B2).

You also get points for professional experience, recognition of qualifications in Germany, age, language skills in German and/or English, connections to Germany and the potential of a partner or spouse coming with you.

Opportunity Card workers are allowed to work up to 20 hours a week or on a trial basis. The opportunity card can be extended for up to two years if there is a work contract for qualified employment.

Regulation of the Western Balkans

Another regulation affects people from Western Balkan countries. The so-called Western Balkans Regulation for the recruitment of workers from Albania, Bosnia-Herzegovina, Kosovo, Montenegro, North Macedonia and Serbia is now valid for an unlimited period.
