The murder and disappearance of Jan Prenga/ The two SPAK prosecutors clash with each other in the GJKKO Appeal, for the claim against the 'Golden' gardener!

The court hearing for Festim Bixhdili, the gardener of "Golden Resort", is taking place at the GJJKO Appeal, where the body of Jan Prenga , who was kidnapped and then allegedly murdered, was last seen .

Behar Dibra has requested a 20-year prison sentence for Festim Bexhdili, while the other prosecutor, Elida Kackini, is standing by the request for life imprisonment.

"With respect to my colleague and in agreement with the submissions she made, I have a different assessment of the elements of the defendant's guilt. The fact is that the criminal offense of 'holding Jan Prenga hostage' is a consequence of an activity carried out in England by another defendant who is in a different proceeding."

Festim Bexhdili's presence inside the complex at 12:15 may have been due to his work. He is Altin Hajri's cousin and worked at the complex. There is no evidence that Festim Bexhdili knew Aldo Majnishta, Korado Geshtenja, Dritan Rexhepi, etc. At 18:49 Festim Bexhdili helps Majnishta and Martin Bleta remove Jan Prenga from the trunk of the car and then moves him to another vehicle.

"The vehicle in which the body was placed is loaded with Altin Hajri, Geraldo Martini, Aldo Majnishta and others, and then the vehicle returns to the complex without Jan Prenga's body. The body was already hidden. There is no evidence of the physical finding of Jan Prenga, we cannot ask the defendant to say something that he may not know," said SPAK prosecutor Behar Dibra.

While prosecutor Kaçkini stated in the session that:  "We assess that the decision of the GJKKO, given for Festim Bexhdili, should be left in force as a decision based on the law and evidence. The defendant should be declared guilty regarding the criminal offenses we have filed against him. The kidnapping was warned because the victim was followed for several consecutive days. The "Golden" complex was predetermined by them.

The defendant, on the day of the incident, had a different location from the complex until at least 10:57, when he entered in the direction of Shijak. He was found in the complex, referring to the video footage, at 11:19 and goes in the direction of a garage, then appears paying increased attention to his mobile phone. He appears waiting at the entrance door of the garage. The Audi A6 car belonging to Altin Hajri then enters this door.

This manner of interaction shows that they were aware and each of the defendants headed towards the complex to carry out their roles. Altin Hajri appears at 11:27, while at 11:36 the perpetrators' vehicle arrives. The actions taken convincingly show that Festim Bexhdili was aware of the event. In the totality of the evidence, we assess that the defendant had an active role in the event, so the decision with life imprisonment is proportionate. The defendant has not expressed any remorse, has not apologized to his family, has only maintained a denial, not an explanation.

The gardener was sentenced to life imprisonment, but the case was returned for retrial by the Supreme Court. The verdict for gardener Festim Bexhdili will be announced on July 25.
